D. 1742. for Exportation, the Importer thereof do make Oath (or being a ghwker) a folemn Affirmation, before the proper Officer or Officers of the Cuftoms (who has or have hereby Power to adminifter the fame) that fuch Cambricks were imported into Great Britain, after the faid firft Day of Augujl' one thoufand fevcn ljundred and forty-two; and that the faid additional Duty had been paid for the lame, and had not been fince drawn back; any thing herein contained to the contrary notwithstanding. Taking a falfe XIV; And be it further enacted by the Authority aforefaid, That if any Perfon (hall falfely make any 0atl j> to f£ lt Oath or Affirmation. by this Act di reded to be made, and fhall thereof be legally convicted in any of his imprifoned r» Majefty's Courts of Record in Great Britain, fuch Perfon fo guilty, fhall forfeit the Sum of two hundred Months. Pounds, and be imprifoned for twelve Months. How to recover XV. And be it further enacted by the Aurhority aforefaid, That the feveral Penalties and Forfeitures to* Penalties. in this Act mentioned fhall and may be profecuted, and determined, by Bill, Plaint, or Information, in any of his Majefty's Courts of Record at Wejhninjler or in the Court of Exchequer in Scotland reflectively, wherein no Effoin, Protection, Privilege, Wager of Law, or more than one Imparlance fhall be allowed; and one Moiety of the faid Penalties and Forfeitures fhall be to the Ufe of the King's Majefty, and the other Moiety to fuch Perfon or Perfons as will Cue for, or profecute the fame. XVI. And be it further enacted by the Authority aforefaid, That if any Action or Suit fhall be com- menced againft any Perfon or Perfons for any Thing done in purfuance of this Act; the Defendant or General Iflue. Defendants in any fuch Action or Suit, may plead the General IfTue, and give this Act and the Special Matter in Evidence, at any Trial to be had thereupon, and that the fame was done in purfuance, and by the Authority of this Act; and if it fhall appear fo to have been done, the Jury fhall find for the Defendant or Defendants; and if the Plaintiff fhall be nonfuited, or difcontinue his Action, after the Defendant or Defendants fhall have appeared, or if Judgment fhall be given upon any Verdict or Treble Cods. An Act; for further regulating the Plantation Trade; and for Relief of Merchants importing Prize Goods from America, and for preventing collufive Captures there; and for obliging the Claimers of VefTels feized for Exportation of Wool, or any unlawful Importation, to give Security for Cofts; and for allowing Eaft India Goods to be taken out of Warehoufes, in order to be cleaned and refrefhed.
