Juftices to order XXiV. And be it further enadted by the Autiiority aforefaid. That for the better and more regular Conftables to Provifion of Carriages for his Majefty's Marine Forces in their Ivlarches, or for their Arms, Clothes and ^^"^^(■^^^™=^^ Accoutrements, in England, Wales, and the Town oi Berwick upon Tiveed, all Juftices of the Peace within their March." their feveral Counties, Ridings, Divifions, Shires, Liberties and Preclnfts, being duly required thereunto by the faid Lord High Admiral, or three or more of the Commiffioners for executing ihe faid Office of Lord Hio-h Admiral for theTime being, by an Order in Writing undev his or their refpectie Hand or Hands, fliall as often as fuch Order fhall be brought and fliewn unto on.^ or more of them by the Officer or Officers of the Company or Companies of Marines fo ordered to march, iil'ue out his or their "Warrants to the High Conftables, or Petty Conftables of the Divifion, Riding, City, Liberty, Hundred or Precint3t, from, through, near or to which fuch Company or Companies fhall be ordered to march, requiring them to make fuch Pro- vifion for Carriages, with able Men to drive the fame, as fliall be mentioned in the faid Warrant, allowing them fufficient Time to do the fame, that the neighbouring Parts may not always bear the Bur;hen ; and in cafe fufficient Carriages cannot be provided within any fuch Riding, City, Liberty, Plundred, Divifion or Precinft, then the next Juftice or Juftices of the Peace of the Coimiy, Riding or Divifion, fliall, upon fuch Order as aforefaid being brought or fhewn to one or more of them by any of the Marine Officers aforcfaid, iffue his or their Warrants to the High Conftables or Petty Conftables of fuch next County, Riding, Liberiy, Divifion or Precinft, for the Purpofes aforefaid, to make up fuch Deficiency ; and the aforefaid Officer or Officers, who by virtue of the aforefaid Warrant from the Juftices of the Peace, are to demand the Car- riage or Carriages therein mentioned of the High Conftable or Petty Conftable to whom the Warrant is dire(£l:ed, is and are hereby required at the fame Time to pay down in Hand to the faid Conftable or Petty Rates for Car- Conftable, for the Ufe of the Perfon who fhall provide fuch Carriages and Men, the Sum of one Shilling iiages. ^^^ every Mile any Waggon with five Horfes fhall travel, and the Sum of one Shilling for every Mile any Wain with fix Oxen, or four Oxen with two Horfes fhall travel; and the Sum of nine Pence for every Mile any Cart with four Horfes fhall travel ; and fo in proportion for lefs Carriages ; for which refpe<Sfive Sums fo received, the faid Conftable or Petty Conftable is hereby required to give a Receipt in Writing to the Perfon or Perfons paying the fame ; and fuch Conftable or Petty Conftable fhall order and ap;:oint fuch Perfon or Perfons having Carriages within their refpedlive Liberties, as they lliall think proper, to provide and furnifh fuch Carriages and Men, according to the Warrant aiorefaid, who are hereby required to pro- vide and furnifh the fame accordingly : And if any Marine Officer or Officers, for the Ufe of whofe Corn- Penalty on Offi- pany or Companies the Carriage was provided, fliall force and conftrain any Waggon, Wain, Cart or Car- eers fcrcin;W.-,g-riage, to travel more than one Day's Journey, or fhall not difcharge the fame in due Time for their Return gons to travel home, or fhall fufl:er any Marine or Servant (except fuch as are ficlc) or any Woman, to ride in the Vag- Da/s Tourney^ S°"' Wain, Cart or Carriage aforefaid, or fliall force any Conftable or Petty Conftable by Thrcatenings or &c. ' menacing Vvords to provide Saddle-Horfes for themfelves or Servants, or fiiall force Horfes from the Owners, by themfelves. Servants cr Private JVlen ; every fuch Officer, for every fuch Offence, fhall forfeit the Sum of five Pounds, Proof thereof being made upon Oath before two of f.is Majefty's Juftices of the Peace of the fame County or Riding, who are to certify the fame to the proper Paymaftcr of his ?.!;.jefty's Marine Forces, who is hereby required to pay the aforefaid Sum of five Pounds accordingly to the Order and Appointment under the Hands and Seals of the aforefaid Juftice^ of the Peace of the fame County or Riding, and is alio hereby impowered to dedudl the fame out of fuch Officer's Pay. fhhl'wv Ne". .^^ ^- ^-"'^ ^^ ^ cnaaed by the Authority aforeiiiid. That if any High Conftable or Petty Conft 'ble fliall itfi: to'provide" wilfully negleft or refufe to execute fuch Warrants of the Juftices of the Peace as fli"ll be d;:oded unto Carriages. them for providing Carriages as aforefaid, or if any Perfon or Perfons :ippointed by fuch Conftable or Petty Conftable to provide or furnifli any Carriage and Man, fhall refufe or negleiSl to p.ovide the fame, or any other Perfon or Perfons whatfoever fliall wilfully do any Aft or Thing whereby the Execution of the fiid Wan',aits fliall be hindered or fruftrated ; every fuch Conftable, or other Perfon or Perfons fo offending, fliall, for every fi:ch Oft'ence, forfeit any Sum not exceeding forty Shillings, nor lefs than twenty Shillings, to the Ule of the Poor of the Parifh where any fuch Offence fhall be committed ; and all and every ftTch OfFence and Offences lliall and may be enquired of, heard and fully determined, by two of his Majefty's Juftices of the Peace dwelling in or near the Place where fuch Offence fliall be committed, who have hereby rower to caufe the faid Penalty to be levied by Diftrcfs and Sale of the Offender's Good.- and Chattels, rendering the Overplus (if any) to the Owner.
