and ^een Mary, relating to Carts uj'cd by Perjhns inhabiting tvithin the Limits of the Weekly Bills of Mor- tality ; and to alloiu fuch Carts to be drazun with three Horfcs ; and to prevent the Mijlchavicur of the Dri- vers of Carts in Streets within the faid Limits ; therein reciting (amongft other Things) that great Incon- veniencies had arifen frc'^m the irregular Behaviour of Carmen, Draymen and other Persons driving Carts, Drays and other Carriages within the Cities oi London and IFe/hiinjlcr^ and Suburbs tliereof, the Borough of Southivark, and other Streets within the Bills of Mortality, by their mifufmg and hindering the Palfagc of his Adajefty's Subjects through the fidd Streets and Highways, and committing other Dif- ordcrs of the liice Kiiid j For Remedy whereof it was thereby enucfed. That from and after the twenty- nir.th Day of Septe?nber one thoufand feven hundred and forty-five, no Perfon or Perfons whatfoever fhould drive any Cart, Car or Dray of any Kind whatfoever, within the Limits aforefaid, unlefs the Matter or Owner of fuch Cart, Car or Dray, fnould place upon fome confpicuous Part of fuch Cart, Car or Dray the Name of the Owner of fuch Cart, Car or Dray, and the IS' umber of fuch Cart, Car or Dray fo belonging unto him, in order that the Driver of fuch Cart, Car or Dray might the more eafily be convi6ted for any Diforder or Mifbehaviour committed by him as aforefaid ; and it was thereby furthL-r enadcd. That every Owner of fuch Cart, Car or Dray refiding within the Limits aforefaid, fl^ouid enter his Name and Place of Abode with the Commiffioners for licenfing Hackney Coaches, for which Entry he fhould pay the Sum of one Shilling and no more j and the faid Commiffioners were
- thereby required to receive and regifter fuch Entry as aforefaid ; and it was thereby alfo enadled. That
' in cafe any Perfon or Perfons fhould drive any fuch Cart, Car or Dray, within the Limits aforefaid, not marked, numbered and entered as before dire£led, every fuch Perfon fo offending fhould forfeit the Sum of forty Siiillings, and it fhould be lawful for any Perfon or Perfons to feize and detain the Cart, Car or Dray, or any of the Horfes drawing the fame, and them to detain until fuch Penalty fhould be paid : And whereas no Proviiion is made by the faid Aft, to whom the Money forfeited lliaU go and be p:iid, or to fell the Cart, Car, Dray or Horfe as (hall be feized in purfuance of the faid Aiff, to raife the forty Shillings forfeited;' Be it therefore enadted by the King's mofl Excellent Majefty, by and-- with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Par- Aprtication of liament aliembled, and by the Authority of the fame. That one Moiety of the Money which fhall be- ths ForJeiture. forfeited by the Driver of any Cart, Car or Dray, under the faid A6t, (hall go and be paid to the Perfon or Perfons who (hall apprehend and profecute to Conviftion any Offender or Offenders againft the faid Act ; and that the other Moiety thereof fhall go and be paid to the Overfeers of the Poor, if there fliall be any, of the Parifli or Place in which the Offence fhall be committed ; and if there fhall be no Over- feers in fuch Parifh or Place, then to fome other Officer of fuch Parifh or Place, for the Ufe of the Poor On Non» ay ^^ ^^^^^ Parilh or Place; and if the Offender or Offenders, on being convided of any Offence againft the mtnt within 24 f^^ ^'^U before any JulHce of the Peace within his Jurifdidion, ihiall not within the Space of twenty-- Hours, D.firefs four Hours after any fuch Conviction, pay the forty Shillings forfeited, then the fame fhall be raifed by may be fold. S:ile of the Cart, Car, Dray or Horfe which fliall be feifed ; and every Juftice of the Peace within his Jurifdiction is hereby authorifcd and required to ifluc his Warrant under his Hand and Seal, diredled to the Conffable, or fome other Peace Officer of the Parifh or Place in which the Cart, Car, Dray or Horfe feized fh. 11 be, to caufe Sale to be made thereof with all convenient Speed, for raiffng the Money which Overplus to be ^^H he forfeited for any fuch Offence or Offences as aforefaid ; rendering to the Offender or Off^endcrs jeturned, after the Overplus (if any there fhall be) after dedu6ting the Charges of the Sale of any fuch Cart, Car, Dray •iriiuiting all or Horfe, and alfo the Expences the Party or Parties v/ho fhall have made the Seizure fhall be at by de- Charger. t;ining or houfing thereof, or keeping any Horfe feized, until Sale fhall be made thereof in purfuance of this A6t, or the Money forfeited fhall be paid.
