Drains or Dikes to be roaded, i'coured, cieanfed, deepened and widened relpedfiveiy j and fuch Tunnels to be laid in Purfuance of and according to fuch Notice and Dire61:ion; the Commiffioners fqr fuch refpeftive Diftrict wherein fuch Work is dire6ted to. be, done as aforefaid, or any two or more .qf them, fhall and may, and they are hereby authorized and required to caufe the fame to be done irr a pro- per and effe6tual Manner ; and, by Warrant or Precept under their Hands and Seals, or the Hands and Se:ils of any two or more of them, to authorize and impov,'er their Collector or Colle(51:ors, Receiver or Receivers, or any other Perfon or Perfons, to levy and'raife the Charge and-Expence of doing thereof by- Di- ftrefs and Sale of fuch Goods and Chattels as fliall at any Time thereafter be fecund on the Lands to whic^ fuch Drains or Dikes, Bridges or Tunnels, fliall appertain or belong; rendering the Overplus, if any, to the Owner or Owners thereof; and every fuch Owner or Occupier, for eVery fuch Neglecl, (hall forfeit the Sum of three Pence for every Rod of the Drain or Dike fo neglefted to be depthened, widened, road- ed, fcoured or cieanfed. Provided always, and it is hereby enacted by the Authority aforefaid, That no Mill Drains made in whole fgr conveying the Water to any Mill fliall be cut in the whole Lands of any Perfon or Perfons within the Lands. j-^jj Ytw Lands or Low Grounds, except in fuch Parts thereof as are Adventurers Land or other Grounds Xxception. which contain ten Acres and upwards; nor fliall any fuch Cut or Drain be made in Bury Fen^ but that the Water fliall be iflued and conveyed through the Outring or Divifion Ditches only. Penalty on ma- XXXVL And it is hereby further ena6led, That if any Perfon or Perfons fliall make any Sock-dike, king Sock- or Sock-gripple, on any of the faid Fen Lands and Low Grounds, within the Diftance of ten Feet, in dikes, <5cc. jj^g £j-^^ fccond, third, fifth or fixth Diftrids, or within fixty-fix Feet in the fourth Diftri6f, from any of the Banks which now are, or hereafter fliall or may be made for keeping off the Waters from any of the faid Fen Lands and Low Grounds, or more than one Foot deep in any of the faid Diftricts ; every fuch Perfon fo offending fliall forfeit and pay the Sum three Pence for every Foot in Length of fuch Sock-dikes or Sock-gripples, for every Month during which the fame fliall be continued. Provided always, 'Fhat a certain Dike, called Delph Dike, fliall be and remain, for ever remain dair.cr.ed hereafter, dammed up as it now is ; and the CommilTioners for the fourth Diftrict fliall, from Time to Time, ^^' make and maintain fuch Banks as fhall be neceffary for keeping the fame fo dammed up; and if any Per- fon or Perfons fhall make or caufe to be made any Opening or Openings in the faid Dike, whereby any of the Lands within the fourth Diftrict fhall be prejudiced, every fuch Perfon fhall, for every fuch Offence, forfeit the Sum of five Pounds, and flial! alfo make full Compenfation and Satisfaction to all and every Perfon and Perfons who fhall be injured thereby, for the Damage fuch Perfon or Perfons fhall thereby fuftain; which Compenfation and Satisfaction ihall be recovered, together with full Cofts of Suit, in fuch Manner as is herein after prefcribed for Recovery of Damages fuftained by the Working of any Horfe iVMU or other Device. 1-ands vliich XL.
