D. 1757. le(Sl, within the Space of twenty-four Hours, to return and pay fuch Money, as aforefaid, he or they Ojall be deemed and taken to be inlifted, as if he or they had given his or their Afl'ent thereto before the faid Ju- itice or Chief Mugiftrate ; or if fuch Perfon or Perfons (liall declare his or their having voluntarily inlifted himfelf or themfelves, then fuch Juftice or Chief Magiftrate fhall, and he is hereby required forthwith to certify under his Hand, that fuch Perfon or Perfons is or are duly inlifted; fetting forth the Place of the Birth, Age and Calling of him or them rcfpeitively (if known) and that the fecond and third Seflions of the Ar- ticles of War for the better Government of his Majefty's Marine Forces while on Shore in Great Britain or Ireland, were read to him or them, and that he or they had taken the Oath of Fidelity mentioned in the twelfth Section of the faid Articles of War ; and if any fuch Perfon or Perfons, fo to be certified as duly in- lifted, fhall refufe to take the faid Oath of Fidelity before the faid Juftice or Chief Magiftrate, it fliall and may be lawful for fuch Officer, from whom he has received fuch Money as aforefaid, to detain or confine fuch Perfon or Perfons, until he or they fhall take the Oath before required j and every Officer of Ma- rines that fhall a£l contrary hereto, or offend herein, upon Proof thereof upon Oath made by two Wit- ncfl'cs, before a General Court-martial to be thereupon c lied, ftiall for fuch OfFcnce be forthwith cafhier- cd, and di 'placed from fuch his Office, and fh:ill be thereby utterly difabled to have or hold any Civil or Military Office or Employment within this Kingdom or in his Majefty's Service. XLIII. Provided always, and it is hereby declared. That all his Majefty's Marine Forces, as well Offi- cers as Private Men, fhall, from time to time, during their being refpec^ively borne as Part of the Comple- ment of any of his Majefty's Ships or Vefiels, be fubjecl or liable, in like Manner, in all Rcfpecfls, as any Officers or Seamen employed in his Majefty's Sea Service arc fubject and liable to be governed and proceed- ed agaiiift, and puniflied, for OfFences committed by them during the Time they fhall be borne as Part of the Complement of fuch Ships or VefTels, according to the Purport, Tenor, Effect and true Intent, and Meaning of an A6t of Parliament made in the twenty-fecond Year of his prefent Majefty's Reign, intitul- ed, Jn ASi fcr amending, explaining and reducing into one A£l of Parliament, the Laws relating to the Govern^ rnent of his Majejlys Ships, Fe/Jels and Forces by Sea ; this prefent A£i, or any thing herein contained not- withftanding. CAP. VII. An Act for appointing Commiffioners for putting in Execution an AS: of this Seftion of Parliament, inti- tuled, y/« y^t^ for granting an Aid to his Majejiy, by a Land Tax to be raifed in Great Britain, for the Ser^ vice of the Tear one thcufand feven hundred and fifty -eight; and for enforcing the Payment of the Rotes to be affeffed upon Somerfet Houfe in the Strand ; and for rectifying a Miftake in the faid A£l; and for allowing farther Time to the Receivers of certain Aids, for fetting infuper for Monies in Arrear. CAP. VIII. An Acl for enlarging the Terms and Powers granted and continued by feveral Ads of Parlia- ment, for repairing the Harbour oi Dover in the County of Kent. WHEREAS by an Acl of Parliament made and pafled in the eleventh and twelfth Years of the Rtign of his late Majefty King William the Third, intituled, Jn J^ for the Ref^air of Dover Harbour, feveral Rates and Duties were charged upon Coals, and upon Ships and Veflels, in order to- raife a Sum, not exceeding thirty thoufand one hundred Pounds, to be applied for repairing and perfecting the faid Harbour oi' Dover, under fuch Rates and Direiftions, and with fuch Penalties and other Provi- fions for the levying and recovering the ^^me, as are therein mentioned, inferted and contained ; and which Rates, Duties and Provifions, were to take Place and commence from the fiift Day of i^d[y one thoufand fevcn hundred, and to continue and be in Force, until the firft Day o^ May one thoufand feven- hundred and nine ; and by two fubfequent h£ts, one of them made in the fecond Year of the Reign of her late Majefty Queen Anne, and the other of them in the fourth Year of the Reign of his late Majefty King George the Firft, were continued, and declared to be in Force, until the firft Day of ^^^ one thouland fevcn hundred and twenty-feven : And whereas by an Adl made and pafled in the nint}i Year of his late Majefty King George the Firft, intituled, Jn JSi for compleating the Repairs of the Harbour of Dover in the County of Kent; and for refloring the Harbour of Kye in the County of SuHex to its ancient Goodnefs; after taking Notice of the faid former A(5ts relating to the Harbour of Z>owr, and that it was found that the faid Sum of thirty thoufand one hundred Pounds was not fufficient for the Purpofes of the faid former A6ts ; and that unlefs a further Sum was raifed, the faid Harbour could not be effe(Slually re-, paired and fecured, according to the Intent of the faid former Aits ; but that the ufeful Works then be- gun and carried on for the Benefit of the Publick, would be wholly loft, and the faid Harbour again fall to Decay, and the Town itfclf be in Danger of being utterly loft and deftroyed ; and alfo reciting, that the ancient Harbour of Rye was formerly of great Ufc and Benefit to Trade and Navigation, but the fame was then choakcd up, and that it was neccflary to open the fame in fuch Manner as fnould be found moft proper and expedient to rcftore the faid Hnrbour ; it was therefore cnacfted. That the Ciid ACts refpec- lively made in the eleventh and twelfth Years of the Reign of King William the Third, and the fe- cond Year of the Reign of Q^iccn Anne, for the Repair of Dover Harbour, and every Claufe, Matter or Thing in them, or either of them contained, and not altered by the faid ACt of the ninth Year of King GtoRGE the P'irft, fliould continue, and be in full Force and Virfie, till the firft Day of May one thoufand fevcn hundred and forty-four, for the Purpofes in that and the faid former Acfts mentioned ; and that the Duty of three Pence At'r Ton, granted by the faiil ACt of the eleventh and twelfth Years of King William the T'hird, for the Repair oi Dcver Harbour, upon all Ships and Veflcls therein defcribed, Ihould, from the firft Day of May one thoufiind fevcn hundred and twrcnty-threc, be colleded and receiv- ' ed.
