- XVL And whereas there is and may be occafion for the marching and quartering of the faid Marine
ConftaMfs, &c. * Forces in feveral Parts of this Kingdom ;' Be it further enafied by the Authority aforefaid, 7'hat for to quarter Ofri- ^^fj during the Continuance of this A6, and no longer, (in purfuance of an Order or Orders in Writing, cersandMen in -^ ^,^^^ Behalf, under the Hand of the faid Lord High Admiral, or under the Flands of three or more of l^r.s, Aiebcu.es, ^^^^^ CommifHoners for executing the Office of Lord High Admiral for the Time being) it fhall and may be lawful to and for the Conftables, Tythingmen, Headboroughs, and other Chief Officers and Magi- ftrates of Cities, Towns and Villages, and other Places wx.

-vuick upon Tvjeed ; and in their Default or Abfence, for any one Juftice of the Peace inhabiting in or near any fuch City, Town, Village or Place, and for no others; and fuch Conftables, and other Civil Ma- giftrates as aforefaid, are hereby required to quarter and billet the Marines, both Officers and private Men, in his Majefty's Service, in Inns, Livery Stables, Ale-houfes, Vi6lualling-houfes, and the Houfes of Sellers of Wine by Retail, to be drank in their own Houfes, or Places thereunto belonging, and all Houfes of Perfons felling Brandy, Strong Waters, Cyder or Metheglin, by Retail to be drank in Houfes, But in no Dift'il- other than and except the Houfe or Houfes of any Diftillers, who keep Houfes or Places of diililling krs Houfes, or Brandy and Strong Waters, and the Houfe of any Shopkeeper, whofe principal Dealings fliall be more Shonksepers, or jn other Goods and Merchandizes, than in Brandy and Strong Waters (fo as fuch Diftillers and Shop- in any privace keepers do not permit or fuffer Tipling in his or their Houfes) and in no other, and in no private Houfes Houfes. whatfoever, without the Confent of the Occupier ; nor fhall any more Billets at any Time be ordered, than there are effective Marines prefent to be quartered ; and if any Conftable, Tythingman, or fuch like Officer or Magiftrate as aforefaid, fhall prefume to quarter or billet any fuch Officer or private Man in any fuch private Houfe, without the Confent of the Occupier; in fuch Cafe fuch Occupier (hall have his or their Remedy at Law againft fuch Magiftrate or Officer, for the Damage that fuch Occupier fhall fu- Penalty on Offi- ftain thereby; and if any Marine Officer ihall take upon him to quarter private Men otherwife than is li- ters quartering mitcd and allowed by this A61:, or fliall ufe or offer any Menace or Compulfion to any Mayors, Confta- frivatsMencon- bjg^^ or Other Civil Officers before-mentioned, tending to deter and difcourage any of them from per- irary to this forming any Part of their Duty hereby required or appointed ; fuch Marine Officer ftiall, for every fuch ' ^^' Offence (being thereof convicted before any two or more of the next Juftices of the Peace of the County, by the Oath of two credible Witneffes) be deemed and taken to be ipfo faSio caftiiered, and fhall be ut- terly difabled to have or hold any Military Employment within this Kingdom, or in his Majefty's Ser- vice ; provided the faid Conviction be affirmed at the next Quarter-Seffions of the Peace of the faid County, and a Certificate thereof be tranfmitted to the Judge Advocate, who is hereby obliged to certify p f ■ ved ^^^ ^'^Vi^ to the next Court-martial; and in cafe any Perfon fhall find himfelf aggrieved, in that fuch brbei'ng^q^uTr- Conftabhj, Tythingman or Hcadborough, Chief Officer or Magiftrate (fuch Chief Officer or Magiftrate tered on, may not b?ing 3 Juftice of the Pcace) has quartered or billeted in his Houfe a greater Number of Marines than complain to any |^g ought to bear in Proportion to his Neighbours; and fhall complain thereof to one or more Juftice or Juftices, and be jy/^jces of the Peace of the Divifion, City or Liberty, where fuch Marines are quartered ; or in cafe relieved. xq- Chief Officer or Magiftrate fhall be a Juftice of the Peace, then on Complaint made to two or more Juftices of the Peace of fuch Divifion, City or Liberty ; fuch Juftice or Juftices refpedively fhall have, and is or are hereby declared to have Power to relieve fuch Perfon, by ordering fuch and fo many of the faid Marines to be removed, and quartered upon fuch other Perfon or Perfons, as they fhall fee Caufe; and fuch other Perfon or Perfons fhall be obliged to receive fuch Marines accordingly. Officers and rvfa- XVlL Provided neverthelefs, and it is hereby enacted. Whatlnnhol- XVIIL Provided ahvays. That in cafe any Innholder or other Perfon on whom any Non-commifHon dersmay allow Officers or private Men fliall be quartered by virtue of this Aift (except on a March, or employed in re- jurn quartered cruiting, and likewife except the Recruits by them raifed, for the Space of feven Days at moft, for fuch ^"J.Jj'^'^J '°"" Non-commiffion Officers and private Men, who are recruiting, and Recruits by them raifed) fhall be defirous to furnifh fuch Non-commiffion Officers or private Men wirh Candles, Vinegar and Salt, and with either Small Beer. or Cyder, not exceeding five Pints for each Man per Diem, g^^aUs, and allow to fuch Non-commiffion Officers or private Men the Ufe of Fire, and the ncceflary Utenfils for dreffing and eating their Meat, and fhall give Notice of fuch his Defire to the commanding Officer, and fhall furnifh and allow the fame accordingly ; then and in fuch cafe, the Non-commiffion Officers and private Men fo quartered, fhall provide there own Victuals ; and the Officer to whom it belongs to receive, or who fhall achiaily receive the Pay and Subfiftencc of fuch Non-commiffion Officers and private Men, fhall pay the feveral Sums herein after-mentioned to be payable out of the Subfiftence-money for Diet and Small Beer, to the Non-commiffion Officers and private Men aforefaid, and not to the Innholder, or other Perfon, on* whom fuch Non-commiffion Officers and private Men are quartered; any Thing herein contained to the contrary notwithftanding. ?en»ityonfj- XIX. Provided always, and be it enadted by the Authority aforefaid.
