And be it enacted and declared, That every Tenant, paying the faid Affeffment or Affeffments laft Tenants dif- mentioned, fnall be acquitted and difcharged of fo much Money as the faid Affeffment or Affeffments fhall charged for what amount unto, as if the fame had actually been paid unto fuch Perfon or Perfons, to whom his Rent fhall cy ° pay ' have been due and payable : And if any Difference fhall arife between Landlord and Tenant, or any other, Comrniffionersto concerning the faid .Rates in England, Wales, or Berwick upon Tweed, the faid feveral Commiffioners, or any j" et| ; le Differences two or more of them, in their feveral Divifions, fliall have, and they have hereby Power to fettle the fame, ^^ Tenant, as they fhall think fit; and in cafe the Proportions fet by this or any former Act upon all and every the refpective Counties, Ridings, Cities, Towns and Places in England, Wales, and Berwick upon Tweed, fhall Commiffioners to- not be fully affeffed, levied and paid, according to the true Meaning thereof; or if any of the faid AffefT- «ufe all Defi- ments fhall be rated or impofed upon any Perfon not being of Ability to pay the fame, or upon any empty aS-d^n^ra'ade or void Houfe or Land, where the fame cannot be collected or levied, or that through any Wilfulnefs, * l£ ' a Neglect, Miftake or Accident, the faid Affeffment charged on each County, Riding, City, Town or Place, as aforefaid, by virtue of this or any former Act, happens not tc be paid to the Receiver General, his Deputy or Deputies, as in this or any former AcT: is directed ; that then, and in all and every fuch Cafe and Cafes, the feveral and refpective Commiffioners, Affeffors and Collectors aforefaid, and every of them refpectively, are hereby authorized and required to affefs and re-affefs, or caufe to be affeffed or re-affeffed, levied and paid, all and every fuch Sum and Sums of Money, upon the refpective Divifions or Hundreds wherein fuch Deficiency fhall happen, or Parifhes therein, as to the faid Commiffioners, or fuch Number of them, as by this Act are authorized to caufe the faid firft Affeffment hereby required to be made, fhall feem moft agreeable to Equity and Juftice ; the faid new Affeffment to be made, collected and paid in fuch. Manner, and by fuch Means, as in this Act for other Affeffments is declared and directed. XVII. And be it further enacted and declared, That if any Collector or Collectors, that fliall be, by Collectors de- virtue of this Act, appointed for the Receipt of any Sum or Sums of Money thereby to be affeffed in Eng- Ca ' n m theMo- land, Wales, oxBerwick upon Tweed, fhall refufe or neglect to pay any Sum or Sums of Money, which fhall fa^ v f ' d to th e ei y PJ1 * be by him or them received, as aforefaid, and to pay the fame as in this Act is directed, or fhall detain in date's feizTi and his or their Hands any Money received by him or them, or any of them, and not pay the fame, as by this fuJd, &c. Act is directed; the faid Commiffioners of each County, City, Riding or Town refpeftively, or any two or more of them, in their refpective Divifions, are hereby authorized and impowered to imprifon the Per- fon, and feize and fecure the Eftate, as well Freehold as Copyhold, and all other Eftate, both Real and Perfonal, of fuch Collector, to him belonging, or which fhall defcend or come into the Hands or Pofftffion of his Heirs, Executors or Adminiftrators, wherefoever the fame can be difcovered or found ; and the faid Commiffioners, who fhall fo feize or fecure the Eftate of any Collector or Collectors, fr ail be and are hereby impowered to appoint a Time for a General Meeting of the faid Commiffioners for fuch County, Riding, City, Town or Place, and there to caufe publick Notice to be given of the Place where fitch Meeting fhall be appointed, fix Days at leaft before fuch General Meeting ; and the Commiffioners prefent at fuch Ge- neral Meeting, or the major Part of them, in cafe the Monies detained by any fuch Collector or Collectors be not paid and fatisfied as it ought to be, according to the Directions of this Act, fhall be and are hereby impowered and required to fell and difpofe of all fuch Eftates, which fhall be, for the Caufe aforefaid, feized . and fecured, or any Part of them, to fatisfy and pav into the Hands of the Receiver General, or his Deputy,, for fuch County, Riding or Place, the Sum which 'fhall be detained in the Hands of fuch Collector or Col- lectors, their Heirs, Executors or Adminiftrators reflectively. XIX.
