Non-commilTion Officer embezzling Soldier's Pay, Sec. to be reduced, • XLIIT. Provided always, and be it further enacted, That no Waggon , Wain, Cart or Carriage^ impreffed by Authority of this Act, fliall be liable or obliged, by virtue of this Act, to carry above thirty hundred Weight; any Thing in this A& contained to the contrary notwithstanding. XLlV. And be it further enacted, That the Carriages for the Service of the Forces from Time to Time quartered or marching in Scotland, fhall be provided in like Manner, and at the Rates, and the Furnifher of fuch Carriages fhall be paid, as was directed by the Law in force in Scotland at the Time, of the Union. XLV. And be it enacted by the Authority aforefaid, That if any Officer, Military or Civil, by this Act authorized to quarier Soldiers in any Houf'cs hereby appointed for that Purpofe, fhall at any Time during the Continuance of this Act, quarter any of the Wives, Children, Men or Maid- fervants of any Officer or Soldier in any fuch Houfes, againft the Content of the Owners ; the Party offending, if an Officer of the Army, fhall, upon Complaint and Proof thereof made to the Com- mander in Chief of the Army, or judge Advocate, be ipfb /ado cafhiered ; and if a Conftablc, Tythingman, or other Civil Officer, he fliall forfeit to the Party aggrieved twenty Shillings, upon Complaint and Proof thereof made to the next Juflice of the Peace, to be levied by Warrant of fuch Juftice, by Diftrefs and Sale of his Goods, rendering the Overplus to the Party, after deducting rea- sonable Charges in taking the fame. XLVI. And for the better Prefervation of the Game, in or near fuch Place, where any Officers or Soldiers fhall at any Time be quartered ; Be it enacted by the Authority aforefaid, That if, from and after the laid twenty-fourth Day of March one thoufand feven hundred and fixty-four, any Of- ficer or Soldier fhall, without Leave of the Lord of the Manor, under his Hand and Seal, firft had: and obtained, take, kill or deftroy any Hare, Coney, Pheafant, Partridge, Pigeon, or any cher Sort, of Fowls, Poultry or Fifh, or his Majcfty's Game, within the Kingdom of Great Britain ; and upon Complaint thereof fliall be, upon Oath of one or more credible Witnefs or Witneffes,. convicted before any Juftice or Juilices of the Peace, who is and are hereby impowered and authorized to hear and determine the fame; (that is to fay) Every Officer fo offending fliall, for every fuch Offence, for- feit the Sum of five Pounds, to be distributed among the Poor of the Place where fuch Offence fhall- be committed ; and every Officer commanding in Chief upon the Place, for. every fuch Offence com- mitted by any Soldier under his Command, fliall forfeit the Sum of twenty Shillings, to be paid and diftributed in manner aforefaid : And if, upon Conviction made by the Juftices of the Peace, and Demand thereof alio made by the Conftable or Overfeers of the Poor, fuch Officer fhall refute or neglect, and not within two Days pay the laid refpective Penalties, fuch Officer fo refuting or ne- glecting fliall forfeit, and is hereby declared to have forfeited, his Commiffion, and his Commiffion is hereby declared to be null and void. XLVII. And be it enacted, That there fhall be an exact Account of all Monies due, according to the Mutter-rolls, to every Regiment in his Majefty's Service, made between the Paymafter Ge- neral, or other refpective Paymafters of the Forces for the Time being, and' the Colonel of every, Rich Regiment, or the Agent by fuch Colonel reflectively appointed and authorized to receive the Pay thereof, from Time to Time ; (that is to fay) when four Months become due, an Account fhalL be ftated as aforefaid, for the two preceding Months ; and after the faid Account fhall be fo made up and perfected, it fhall be registered in a Book to be kept for that Purpofe in the Pay-office,. and. there fubferibed by fuch Paymafter General, or other refpective Paymafter, or his Deputy, and the Colonel, or Ageut of the Regiment, who, together with the faid Paymafter, made up the fame; and a Dupli- cate thereof, by them respectively figned, fliall be given to the faid Colonel or Agent, without any, Fee or Reward to bepaid for the fame : Which Colonel or Agent fhall deliver to each Captain of the. Regiment an Account of fo much thereof as refpedtively appertained to>him, and his Troop or Com- pany, and the inferior Officers or Soldiers thereof; and the Balance which fhall remain uponmaking up every fuch Account as aforefaid, and alfo all other Money as then fhall become due to every fuch- Regiment, fhall be, by the faid Paymafter General, or other refpective Paymafter, paid to the faid Colonel or Agent refpedtively, at fuch Time as his Majefty fhall direct : And the Paymafter General j or other refpective Paymafter for the Time being, offending herein, fhall. forfeit, for every fuch Of- fence, one hundred Pounds, to any Perfon or Perfons who fliall inform or fue for the fame in any of. his Majefty's Courts of Record : And if any Deputy of the faid Paymafter, or any Agent of a Regi- ment, flialt offend in the Premiffes, upon Proof thereof made, fuch Deputy or Agent fhall ipfojaclo lofe his Place, and be incapable of that or any other Office for the future, and fhall be liable, to pay two hundred Pounds to any Perfon who fhall inform or fue for the fame, by Action, Bill, Suit or: Information, in any Court of Record at Wejlmitificr, wherein no Effoin, Protection, Wager of. Law, or more than one Imparlance, fliall be allowed : And if any Colonel of a Regiment fhall offend* therein, fuch Colonel fhall forfeit, for every fuch Offence, one hundred Pounds, to any Perfon or Perfons who fhall fue for the fame, to be recovered as aforefaid. XLVIII. And be it further enacted by the Authority aforefaid, That every. Non-eommiffion Of- ficer who fhall be convicted at a General or Regimental Court Martial, of having embezzled or mis- applied any Money with which he may have been intrufted for the Payment of the Men under his Command, or for inlifting Men into his Majefty's Service, fliall be reduced to ferve in the Ranks as a Private Soldier, and be put under Stoppages until the Money be made good, and fuffer fuch- corporal Punifhment (not extending, to Life or Limb} as Jhe Court-martial fhall think fit.. « xlix;.
