IV. And be it further enacted by the Authority aforefaid, That if any Perfon or Perfons fhall, during the next Recefs of Parliament, land any fuch falted Beef, Pork or Butter, or any fait Beef called Dried Beef, or Dried Neats Tongues, or Dried Hogfmeat into this Kingdom from Ireland, before Payment of the Duty or Duties by this Act fpecified and directed, the fame fhall be forfeited and loft, and twenty Shillings per Barrel for every Barrel thereof, and fo in Proportion for any greater or lefs Quantity, to be recovered of the Importer or Proprietor thereof; and that it fhall and may be lawful to and for any Perfon or Perfons, being an Officer or Officers of the Cufloms, or of his Majefty's Duties upon Salt, to take and feize all fuch Commodities as fhall be imported and landed, contrary to the true Intent and Meaning of this Act, together with the Cafks, Vtfiels and Package containing the fame ; and that all fuch Penalties and Forfeitures fhall be diftributed in Manner following; that is to fay, one Ajlo.iety thereof to the King, his Heirs and Succelfors, and the other Moiety thereof to the Perfon or Perfons who fhall feize, fue or inform for the fame; to be recovered by Action of Debt, Bill, Plaint or Information in any of his Majefty's Courts of Re- cord at Weflminjler. V. Provided always, That no Drawback fhal! be allowed or paid for any fuch falted Beef or Pork fo imported into this Kingdom from Ireland, and which fhall be exported from hence elfewhere. VI. And be it further enacted by the Authority aforefaid, That if any Action or Suit fhall be commenced againft any Perfon or Perfons for any Tiling done in purfuance of this Act, the Defen- dant or Defendants, in any fuch Action or Suit, may plead the General Ifltte, and give this Act and the Special Matter in Evidence, at any Trial to be had thereupon ; and that the fame was done in p'urfuance and by the Authority of this Ait: And if it fhall appear fo to have been done, trie Jury fhall find for the Defendant or Defendants; and if the Plaintiff fhall be nonfuited, or discon- tinue his Action after the Defendant or Defendants fhall have appeared, or if Judgment fhall be given upon any Verdict or Demurrer againft the Plaintiff, the Defendant or Defendants fhall and may recover Treble Cofts, and have the like Remedy for the fame as any Defendant or Defendants hath or have in other Cafes by Law. VII. Provided always, and it is hereby declared to be the true Intent and Meaning of this Act, That nothing herein contained fhall extend to authorize the free Importation of falted Beef, falted Pork, Bacon or Butter from Ireland, unlefs when the Price of the belt Ox Beef in Smitbfield Mar- ket fhall exceed three Pence per Pound for the four Quarters, and unlefs the Price of the beft Pieces or fuch Eeef fhall exceed four Pence per Pound at Leaden Hall Market, and unlefs the Price of the beft Pork mall exceed four Pence per Pound, the beft Bacon feven Pence per Pound, and of the" beft Butter fhall exceed nine Pence per Pound, at Leaden Hall Market aforefaid. VIII. Provided always, and be it enacted by the Authority aforefaid, That no Order, Permi/Hon or Authority for the Importation of Butter from Ireland into this'Kingdom, fhall be given or granted till after the firft Day of June one thoufand feven hundred and fixty-four. Part of the Duties on Salt. Any of the faid Provifi ons being landed with- out Duty is ftrft paid, are forfeited with zos, per Barrel, Recovery and Applica- tion of the Penalties.
