(1566), 8 Eiiz. He d. from an accident, at Thetford, co. Norfolk, 17 May 1569, aged 8 years. The nature of his Peerage (which was assumed by the heir male as a Barony in tail male) being called in question, it was adjudicated by the Commissioners( b ) as having been cr. by writ( c ) and conse- quently as being (then) in abeyance between the three sisters and coheirs of the last Lord.O Any right possessed by the Lords Dacre, (1516-69) to the Barony of Grey- stock, fell undoubtedly iuto such abeyance. (") He doubtless considered the old Barony of Multon of Gillesland (1307), of which the former Lords Dacre were heirs, to huve beuu transferred, together with the lands of Gillesland, by the award of 1473. The date of the Barony of Morley was, if not, 1299, certainly as early as 1317. ( b ) These Commissioners were appointed at the request of (the Duke of Norfolk) the Earl Marshal (in lieu of himself adjudicating thereon) to avoid suspicion of favour, inasmuch as he was step-father and guardian of the three sisters and coheirs of the last Baron, all of whom he afterwards married to his three sons. Their decision, however, appears to have been much influenced by his Grace's views and interest. Mr. Townseud (" Coll. Top. et Gen.," vol. v. p. 328), remarks on it " litis decision teas wrong. The award of King Edward IV, did certainly entail the Barony of Dacre of Gillesland, with advice of the Judges in Pari, upon Hie heirs male of the body of Thomas, Lord Dacre, who d. 37 Hen. VI ; George, the young Lord, inherited the dignity as heir male, aud upon his death, without issue, Leonard became heir male aud in that character rightfully assumed the title of Lord Dacre of Gillesland." See also p. 10, notes " a " aud '* b," ( c ) The writ to which they ascribe its origin is " 13 Ed. IV," a writ which actually does not exist, no Pari, having beeu sum. between 12 and 22 Ed. IV. To this last named Pari. (1482^ the first Lord was first sum. while the date (1473) 13 Ed. IV, was that of the award of the Barony to /teirs male. This award of the King, the Commissioners do not appear to have had before them, it having, not un- likely, been purposely withheld to favour the Howard claims ; at all events no allusion to it whatever is made, so that, if produced, it must have been purposely ignored. (■') These were (1), Ann. aged 12 years in 1566, who m. in 1571, Philip (Howard), Earl of Arundel, ancestor of the Dukes of Norfolk. (2), Mary, m. Thomas Howard, afterwards Earl of Suffolk and d. s.p. (3), Elizabeth, m. Lord William Howard. All three were sons of Thomas, 4th Duke of Norfolk, stepfather to the three ladies. The youngest sister inherited Naworth Castle, her moiety of the Baronies in abeyance, being represented by the Earl of Carlisle. The eldest inherited Greystock, her moiety being represented by (1) the Lord Mowbray, Segrave anl Stourtou, aud (2) the
