He m. thirdly, Margaret, sister of John, 1st Karl of Tweeddale [S.] da. of James (Hay), Lord Hay of Yester [S.], by Margaret, da. of Mark (Kerr), Karl of Lothian [S.] He <i , 16 June 1022, at Pinkie, near Musselburgh, and was bur. at Dalgety, co. Fife. Fun. entry in Lyon Office. Will dat., 4 March 1620, to 12 June 1622, pp., 30 Sep. 1625, at Edinburgh. His widow, m. (contract, 1G33), James (Livingston), 1st Earl of Calendar [S.J, who d. Mary, 3d da. of William (Douglas), Earl of Morton [SJ, by Ann, da. of George (Keith), Earl Marischal [S.] She d. at Fyvie about 1659. He d. about 1673, before 11 Jany. 1673/4. III. 1G73. 3. Alexander (Seton), Earl of Dunfermline, &c. [S.J, s. and h., styled, v.p., Lord Fyvie. He d. s.p. shortly after 1673. IV. 1675? If. James (Seton), Earl of Dunfermline [1G05] and to Lord Fyvie [1o9S] in the peerage of Scotland, br. and h. He served 1G90. abroad under the Prince of Orange, but, returning home, adhered to the cause of King James II., being in command of a troop of Horse at the famous battle of Killiecrankie, 17 June 1689. For this he incurred "a decreet of forfaulture " by the Pari. [S.] of 1090 whereby all his honours became forfeited. He followed King James to France who is said to have made him K.T. He hi. Inn) 8 Feb. 1800; Commissioner of Bankruptcy ; Auditor to the estates of the Duke of Devonshire ; M.P. for Midhurst, 1807-12 ; for Calue, 1S12-30, and for Edinburgh, 1S32-39 ; Judge Advocate General in Canning's Ministry, 1827 ; Chief Baron of the Exchequer [S.], 1830-32 ; Master of the Mint and a member of the Cabinet, 1S34 ; and finally ( a ) The issue male of Sir William Seton, the yst. br. of the 1st Earl, having apparently failed on the death of his two sons, the heir male of the grantee is, apparently, in the issue of Sir John Seton. the next elder br. of the Earl. Should it here exist such heir would be entitled " without any reversal of thc attainder to the dignity of Lord Fyvie [S.], as the heir male of the substitute named in the charter of creation," and with, such reversal to the dignity of Earl of Dunfermline. Jf, however, the issue male of Sir John has failed there remains but the eldest br., viz., Robert, 1st Earl of Wiutouu [S.] to whom, in 1810, the Earl of Eglintouu [S.] was served heir male general, the' to whose Feerayc Dignities he did Not establish his right.
