(d. 152U) was father of Sir Thomas M. (living 1509) father of Sir Thomas Maclellan (his s. and h. d. 1597), father of Robert, the 1st Lord. He, who appears to have been a Glover(») in Edinburgh, assumed the peerage dignity in 1720 and was on 9 Alttfl 1734, nerved heir male to the late Lord and, with the exception of the year 1744, voted at all the elections of Scotch Rep. l'ecrs from 1737 to 1761, ( b ) but was ordered by the House of Lords, 14 Dee. 1701, " not to presume to take upon himself the title, &c, of Lord Kirkcudbright until his claim shall have been allowed in due course by law." Col, retiring from the service in 1789. He sue. his Father about 1702. His petition for hit right to the peerage [S.] having been referred to the House of Lords, they, on 3 May 1773, derided in his favour, and ho was received accordingly at Court on the. 1 1th. He m. in or before 1708 Elizabeth, da. of ( — ) Bannister, or BaKNKUMAK, of Hampstead, eo. Midx., or of Hampshire, or of the Isle of Wight. He </. in Hereford street, Midx., 24, and was bur. 28 Dee. 1801 at Paddington, in his 73d year. His widow ((. in Manchester Square, 15 June 1807, Will pr. 1S07. IX 1801. 0. B.p. at Kaeberry Lodge, Southampton, 10 April 1827, aged 55. Will pr. March 1828. His widow hi. 17 Nov. 1828 at Northwood, Isle of Wight, Robert Daviea, of Cowes. an ollieer in the Royal Navy (who survived her), and d. 28 May 1835 at Cowes. Will pr. June 1S35. X. 1827. Jo. ( — ) Sarah, da. of Col. Thomas GORGES. He d. s.p. 19 April 1832 in his 58th year at Bruges in Flanders, when the peerage became dormant or extinct.( a ) His widow d. at Bath 21 Jan. 1S03, aged 82. (") See the protest against his vote for the election in 1731 of Scotch Peers in " Robertson," p. 154. 00 At the elections of 1741 and 17 42, James Maclellan (s. and h. of Sir Samuel M., Merchant, and sometime Provost of Edinburgh) also recorded his vote as Lord Kircudbright. His claim (which he had asserted as early as 1731) was " both as asserted nearest heir male of the family, and founding upon a pretended resignation of the honours by a previous Lord Kircudbright, but what that was does not satisfactorily transpire, and the right seems to have been visionary." (— ) Maclellan, Master of Kircudbright, had d. an infant v.p. March 1741. ( c ) " It appears probable that in his person the line of his immediate ancestor, James Maclellan of Balmaugan (who d. about 163") became extinct. James M. had 2 younger brothers, William and Thomas, both of whom were living 1000, but it has not been ascertained if there be issue male from either of them now in existence. It is, however, extremely improbable that the family of Maclellan of Bombie should have entirely failed, and Dr. Maclellan and Gen. George Maclellan of the United States are said to be members of this family. If there be an heir male of the liist peer in existence, the dignity is de hire vested in htm." [Hewlett, p. 57.]
