ITEM, For-fa-meikil as it was ftatute and ordained of before be ane acte maid in the Parliament halden at Edinburgh , the twentie daie oijumj , the zeir of God , ane thoufand , five hundreth , fiftie five zeires, that all refignationes to be maid be vafialles of their proprieties in the fuperiours hands , ad perpetuam rema- nentiam , being maid be procuratorie , the faid procuratorie fulde bee fealed and fubferived bee the vafialles hands , and gil he coulde not write to be fubferived with his awin hand at the pen , led be ane authen- tick Notar, and fealed with his feale , and r gif the faid refignation beis maid be the vafial perfonallie, ad perpetuam remanentiam , that the inftrument theirof be fealed with the feale of the refigner, and fubferived with his awin hand , and gif he cannot write , to be fubferived with his hand at the pen , led be ane Notar in mancr forefaid , and na refignation ad remanentiam to have ftrength in times to cum, utherwaies nor is abone fpecified : And it being now underftand to the Queenis Majeftie , and the three Eftaites of this Realme , that the faid act lies not bene dewlie obferved , nor univerfally cum in ufe , and that be reafon the famin came not to the knawledge of the haill Lieges of this Realme , quhair-throw they may be prejudged and hurt in making and receiving of fik refignationes , be the tenour of the forefaid Acte : Therefore , and for uther reafonable confiderationcs , the Queenes Hienes and die three Eftaites forefaides, lies difpenfed , and difpenfis with the faid acte , and declaris all refignationes maid in the fupe- riours handes , be quhat-fum-ever vafial, tennent or uther perfon ad perpetuam remanentiam , fenthedait of the faid act, to be fufficient and vailzieable in the felfe, not-with-ftanding the faid acte, fwa that the famin may be verified and provin to have bene maid be inftruments , or uther authentick writtinges , or fufficient probation , that wald have maid faith and fufficient and lauchfull verification theirof, be the ufe and confuetude of this Realme , obferved and keiped in fik-like cafe , anent the making of refigna- tiones ad perpetuam remanentiam , before the making of the faid acte , like as her Grace and Eftaites forefaides , difpenfis with the faid acte and contentis theirof , anent all refignationes ad remanentiam maid in onie time by-gane , fen the faid xx. day oijunij , and to be maid hereafter , quhill the firft daye of ^March , nixt to-cum , in this inftant zeir of God, ane thoufand, five hundreth, threefcore three zeires. 82. That Jive or fix of the principal Burr owes be warned, for concluding of 'weir ', peace, or taxationes. ITEM, The Queenis Grace being of will and minde, that all Proveftes, Alder- men, Baillies, Coun- cellandcommunitie, andinhabitantesofBurrowesofthis Realme, be rather augmented in their privi- ledges maid be her Grace and her predecefioures to them , nor diminifhed thcir-intill : Hes ftatute and ordained be the advife of the three Eftaites of this prefent Parliament , that five or fex of the princi- palis , Proveftes , Alder-men , and Baillies of this Realme , fall in all times to-cum be warned to all conventiones that fall happen the Queenis Grace and hir fuccefibures to conclude upon peace or weir, with quhat-fum-ever her Hienes confederates , or Enemies , or making or granting of generall taxa- tiones of this Realme. And that her Hienes or Councell , fall not conclude nor decerne upon peace , weir, nor taxationes forefaidis , without five or fex of die faidis principalles , Proveftes, Aldermen, and Baillies of Burrowis be warned theirto lauchfullie , as effeiris. 85. t^Anent the Jiancheing of tumult es within Burr owes. ITEM, It is ftatute and ordained be our faid Soveraine Ladie , with advife of the three Eftaites forefaidis, forftanchingandfuppreflingoftumultes, uproares and troubles , that lies happened within Burrowes in all times by-paft : That nane of our Soveraine Ladies Lieges prefume , pretende , or take upon hand to make onie privie conventiones nor afiemblies within Burgh, put on armour, cleeith diemfelves with weapones or make found of Trumpet or Talbrone, or ufe culveringes, difplayed banners, handfeinzeirs, or uthers inftruments bellical quhat-fum-ever, in onie time heireafter, without the fpecial licence of our faid Soveraine Lady , and her Hienes Magiftrates within die Burgh , quhair the faid tumult and uproare chauncis to be, had and obteined theirto, under the paine of death : Providing, that the raifing and convening of the inhabitants of the faidis Burrowes be the Magiftrates ,) for execution or repreffing of malefa&ours be Juftice , be not comprehended under this acf e. »• C c ._ .„ 84.
