OUR ifoveraine Lord , with advife of his three Eftaites of this prefent Parliament , having confiddered the act maid in the Parliament , halden at b d'mburgh , the xxij . day o{<L%laij , the zeir of God , ane thoufand, five hundreth , fourfcoir, four zeires, anent deprivation of Perfons, provided to benefices of cure, under Prelacies , for none-refidencc at the Kirks 01 their benefice, and that it fuld be compted none-refidence to be abfentfra their function four iiabboth daies in the zeir: Be quhilk Aft commiffion is granted to certain Ecclefiaftical perfones mentioned therein ; To call and conveene before them, the perfones delated and fufpefted as non-refidentes , or for uther caufes mentioned in the faid Afte , quhilks neceflarlie requiring ex- planations , and doubtes dailie fallen out there-upon. Therefore declaris , flatutis and ordainis , that the faid Acte and commiffion directed therc-upon , is , nor at na time hereafter fall be extended , againft on ie of the Lordcs of fecreete Councell , or .Senatours of the Colledge of Juftice , or their members , occupied, or daylie attending on hbHitnciler-cccflaryfervice: Or againft ony perfons being foorth of die Realme , be his Hicneflc licence, andempioycdinhisfpecialfcrvice, during the time of their abfence. Quhilkis not- withstanding, fall be aftnfted and halden to fuileine qualified Minifters at their Kirkes in their abfence. Neither fall the faid aft and commiffion be extended againft fik Perfones, as were provided to Benefices of cure, under Prelacies , being iaick Patronages, before the making of the faid Afte of deprivation for non- refidence, and uther caufes lpecificd therein : Bot that the haill Perfones bruikand benefices, in cafes be- fore declared , fall enjoy and poilefle their benefices during their life-times , fuftenand the miniftrie , accord- ing to fikordour, as is taken, or fall be taken their-anem : As gif the faid Aft and commiffion hadnocht bene granted. And that alwaies fik Perfons, a> hes receiv ed benefices , and bene collationat , upon condition to ferve in the funftion of the Miniftrie , and to make refidence , and zit failzies their-intill , fall be fubjeft to the judgement of the laid Afte and commiffion. 33. Anent the Parliament. -. . OURSOVERAINE LORDE, Now being of lauchfull and perfite age , and confiddering the decay of the forme , honour and Majefiie of his iupreeme Court of Parliament, be occafion oi the troubles that hes occurred, fen the deceafe oi his deareftGud-fchir, King JAMES the Fifth of worthie memorie , and willing to reftore the fame to the auncient ordour , dignitie and integritie , hes thoucht expedient, and be advife of his three Eflaites aflembled in this prefent Parliament, flatutis and or- dainis, as followis. THAT There fall be na confufion of perfones of the three Eflaites: That is to fay, na perfon fall take upon him , the funftion , Office or place of all the three Eflaites , or of twa of them : Bot fall only occupy the place of that felfe eflait , quhairin he commonly profeffis hirhfelfe to live , and quhairof hetakishisftile. 34. The unlaw of ahfentes fra th§ Parliament. THAT In-cafe ony Erie, Lord or Barron of Parliament, Prelate, or Burgh, being lauchfullie warned, abfentis themfelves fra Parliament without lauchf ull and fufficient excufe, admitted and allowed be the Lords of the artickles : Our Soveraine Lord, and his three Eflaites, prefentlie conveened, hes ordained , and ordainis, that ane pecunial paine fall be modified and tanc of everie ane of the non-compeirances , in maner following: That is to fay, of everie Erie , three hundreth pundes.- of everie Lord, ioo. pundes: of everie Prelate , 100. pundes, and of everie Burgh , ioo.markcs. And that fik as accompanies nocht the Kingis Majefiie, on horf-backdeccntlie, withfute-mantilles, from his Hienefle Palice , to the Parliament Q^j houfe.
