BECAUSE TheNobilitie, Erles, Lords, and Barronnes, auncient heritoures of landes , livinges, and pofleffiones , underftoodc the inftitution of the College of Juftice , and Lordes of Seffion , to have bene fra the beginning, for decifion of all civill aftiones ; unto the quhilk decifion their hail! heritages, livings, landes, and pofleffiones are fubjecl: : And that his Hienes Progeriitours inftitute the faid College of cunning and wife-men : Quhilk his Majeftie willing to continew , accordi ng to his for-bearis gud intention : And to forefee the corruption increafand in the faid College, in this latter and declining age, declairis his Hienes minde be Acle of Parliament : That in ali times hereafter quhen onie place fuld vaik in the Seffion ; That his Majeftie ibid prefent and nominate thereto , a man fearing God , of gud literature , praciik , judgement, and underftanding of the Lawes, of gud fame , having fufficien t living oi his awin : Ancf quha could mak gud ex- pedition, and difpatch in matters mitching the Lieges of die Realme. T HEREFORE OUR faid SOVERAINE LORD, with advife of the Eftaites of this prefent Parliament , declairis that nane fall be received to ane place oi ane Senator in the College of juftice, except he be fuffkientlie try ed and knawin be his Hienes and haiil Lordes of the Seffion : - That the faid perfoii , to be prcfented and received , have in zeirlie rent , propetlie perteining to himfelie , the fumme oi ane thoufand markesufuall money of this Realme, or els twentie chalders of victuall: and that his experience , qualitie, and converfation, may be the better tryed , that he be of the age of twentie five zeires at the leaft comoleit , in all time cumming , utherwifehisprefentationandadmiffiontobenull, annulland all prefentationes , given and granted be his Majeftie , fen his Hienes Coronation , to quhat-fum-ever perfon or perfons, not beand of the age forefaid : ratifiand neverthelefle and apprievand alwaies all ades maid be his Majefties predecef- fours, and his Hienes felfe of before, upon the inftitution of the faid College, and reformation of the abufes theirof. 133. Touching the authentic k daiting and regiflring of fignatoures. OUR SOVERAINE LORD with the advife of his Eftaites , lies ftatute and ordained ; thatna fignatoures fall pafie the Regifters , of his ordinar officiares of eftaite under-written : Except the dait thereof be filled up with the handes of the Thcfaurer , Colleftour, Comptroller, Thefaurer of augmentations ! and Secretar, or their principal Clerks awin handes •. And that the regiftration of the Signatour, or letter beare not onelie upon the back of it (regiftrat) But the dale and dait of the regiftration , with the number of the leaves of the buik , quhairin it is regiftrat ; Quhilk buik, fall be marked be the hande of the Clerke of Regifter, or his depute conftitute to that e fled. Quhilks warrands fwa marked , fall be maid furth cummand to onie partie intereiled , for tryall of the ante-dait , be the keepers ofthefignet and privie feale; And diat the tryall of the faidis ante-daites , fall not be received , with- out verie great adminicklcs , and certaine circumftances of falfed : And that the fumme configned for impro- bation be maid verie great ; The forme of the improbation fall onelie be received be the writers of the Signa- tures , the principal Officiares , their deputes or Clerkes , keepers of the Regifters , keepers of the Signet , privie feale, and their fervandes , writers of the precept , and writers to the great Seale , and keepers of the fame, andnauthers. And the punifhment of fik falfed, gif onie beis found and tryed , fall be punifhed with the paine of falfed and lefe-majeftie : And three partes of the landes and guddes of the offender, to be adjudged to the King , and the fourth part to the partie grieved. 134.
