FORSAMEIKLE As our Soveraine Lord , and Eftaites of this prefent Parliament , having confid- dered how neceflarie and expedient it is , that the power and jurifdiction of the Deane oiGild, and thek Councell widiin Burgh, be approoved and allowed , as it is now ufed in the zoun oi Edinburgh : quhilkis to the great furdierance of Juftice to our Soveraine Lords Lieges , in all actions and maters concerning Mer- chands; betuixt Merchand and Merchand , and betuixt Merchand and Mariner ; quhilk actions, audit nor, nor fuld not byde delay; Bot be exped and decerned be the Deane ofGild and his Councell fummarhe, as menchofenandappoyntedzeirlie, be the Councell oi" the Burgh; maift apt and able to judge and decernc in all a&iones concerning Merchandes, as faid is : Quhairfore OUR faid SOVERAINE LOPvDE, Widi advife of the Eftaites in this prefent Parliament , ratifies and confirmis , the judgement of the faid Deane oiGild and his Councell, in all acliones , concerning Merchandes; as the fame is fet dovvne be the Proveft , Baillies , Councell and Deacones of the Burgh o[ Edinburgh : And to have full ftrength, force and effect, in all times, according to the lovable forme of judgement, ufed in all gud tounes oi France and Flanders, quhair Burfes ar erected and conftitute ; And fpeciallie in Taris, Roan, Bourdeaux , Rochell: And the particular forme thereof, to be {qz downc againe in this prefent Parliament. 181. The commoun good of Burrowes fuld be rouped, and imflqyed to the commouh weill of the Burgh. OUR SOVERAINE LORDE, With advife and confent of the Eftaites in this prefent Parlia- ment, lies decerned, concluded and ordained : and be thir prefenris , decernis, concludis and ordainis, that die commoun gud and patrimony of all Burghs within this Realme , fall be zeirly beftowed , at the fight of the Magiftrates and Councell of die faidis Burrowes , to the doing of the commoun affaires thereof allaner- ly , after the zeirlie rouping and fetting diereof, as ufe is: conforme to his Majefties former aetes and ftatutes, .maid anent the imploying of the commoun gude within die faidis Burrowes : And that the famin be na uther- wife beftowed or converted to quhat-fum-ever ufe or alteration, maid there-anent , in haill or in part .
