URSOVERAINELORDE, With advife of his Eftaites of this prefent Parliament, ratifies andapprievistheaclesandftatutes, maid be his Hienefle maift Noble Progenitoures of worthie me- morie , concerning the uphalding of Landes , given in conjuncl infeftment, alfweill to Burgh as Land : And for the better execution thereof, and reparation of die decayed policie within Burgh, ftatutis and or- dainis ; That the Proveft and Baillies of ilke Burgh , fall at the inftance of the heritoures of the landes within thefamin, upon citation of the partic, take fummar cognition oftheeftaite of the landes, houfes, or tene- mentes within the Burgh , be ane condigne inqueft of the Nichtboures thereof: And gif the famin be found aulde, decayed, and ruinous in ruife , fclaites, dures, windowes, fluring, lofiis, tymmer-wark, and walles, oronieofthem, and ane land bigged of aulde, and throw lang time decayed , in fik fort that it be already inhabitable , or that within fhort time may becum inhabitable , in that cafe , to decerne that the con- juncl fear or life-renter fall repaire the faidis landes, and tenementes in the partes theirof decayed , as fall be found be the faid inqueft, within the fpace of zeire and day, nixt after they be required theirtobethe heritours: and failzeing theirof, declairis that it fall be frie to the faid heretour , to enter to the poffeffion of the fame, to have the letting, raifing, ufing, and difponing their- upon, in all time camming , as gif there war na life-rent , or conjunct fee (landing theirof. Providing alwaies , that fufRcient fecurity in the Burgh, quhair the iandes or tenementes lyis, betane, for termelie payment to the conjuncl fears or life-renteris theirof, induring their life-time of fikmaill and dewtie, as the famin prefentlie gives the time of the faid cognition, or michtreafonablie give in that eftait, in-cafe it be not prefentlie fet, deduceand alwaies the anuualles, andutherburdinglyandtheir-upon. OUR SOVERAINE LORDE, And Eftaites in this prefent Parliament , confiddering , that notwitliftandingthefundrieAclesmaidbehisHienes, and his maift Noble Progenitours , forpunifh- ment of the Authours of thieft , riefe , oppreffion and forning , and M»ifteris and fufteinares of thieves : Zit fik hes bene, and prefentlie is the barbarous cruelties, and dailie Heirfchippes of the wicked thieves and liffi- mcrs of the Clannes and furnames following , inhabiting the Hie-landes and Iks: They are to fay, Clan- gregore , Clanfarlane, Clanlawren, Clandowall, Qlamonoqnhy, Qlanchattane, Clanchewill, Clanchamron, Qlanrannald 'in Lochaber, Clanrannald 'in Knqydert , Moydert, zndGlengarrey , Clanlewid of the Lewis, Clanlewid of Harriche, Clandonald South and North , Clangilleane, Claniane, Qlankinnon, Clanneil, Clan- kenzie,Clannandreis,C/anmorgun,Clangun,Cheilphale : And als monie broken men of the furnames of Stew- arts in hthole , home , and Balquhidder , Camphelles, Grahames in Menteith, Buchamianes, Galbraithes, Makcaulais,Macknabbes,Makanabrichtes,Meinzeis, Fergu£ones,Spaldinges, Makinto/ches in fKthoil, Mak- thomas mGlenfcbe,FerquhardJbnnes in the Braie o{Mar,Makinpher/bnes,Grantes,KoJ/es,FraJeres,Monroes, Neilfones: and utheris inhabiting the Schireffedomes o{hrgile,Bnte,TDumbartane,StrivilingfPerth,Forjare, Aberdene,Bamf,Elgin,Forres,Name,Innernes,nnd Cromertie, Stewartries olStatheme and Menteith. And likewayes a great number of wicked thieves, oppreflbures , and peace breakers , and receipters of thieft, of the furnames of Armef ranges, El/otes, Nick/ones, Croferes, Grahames, Irwings, Belles, Cairleilles, Beatifones, hitks,Thomfones,Glendfmninges,Carutheres,Iohnefones,Iardanes,Moffettes,luatimers:^n^ ing the Bordourcs fore- anent England, in the Schireffedomes of Koxburgh, Selkirk, Peibles, T>umfrife, and Stewartrie of Knnandaill. In the Murther, Heirfchip, and dailie oppreffion of his Hienefle peaceable and gude fubjecles ; In the haill Countries adjacent to the Hielandes and Bordoures; to the difpleafure of God,contempt and dilhonour of his Hienes perfon and authoritie; and to the waifting and defolation of a gud part of the plentifuil ground oi the country , ii fpeedy remeid be not provided. And underftanding that this mifchief and fchametull difordour increafis , and is nurifhed be the overfight, hounding-out, receipt, maintenance, and not punifhment of the thieves, limmers and vagaboundes ; partlie be the Landis-lordes , Maifters, and Baillies of the landes and boundes, quhair they dwell or refortis : And partly throw the counfelles, direclions, receipt, and partaking of Chieftaines principalles of the branches, and houllialders of the faidis furnames and Clannes, quhilkis bearis quarrell , and feekis revenge for the leaft hurting and flauchter of onie ane of their unhappie race , although it were ordour of Juftice ; or in refcuing and following of trew mennis geare , ftollen or reft: Swa than the faid Chieftaines, principal of the branches , and houllialders , worthelie may be efteemed the verie authors , fofterers and mainteiners of the wicked deedes of the vagaboundes of their clannes and furnames. FOR remeid quhairof, and that there may be anis a perfite diftinclion be names and furnames , betuixt them that ar , and defiris to be efteemed honeft and trew men : and them , that ar and afchamis not to be efteemed thieves, reifers, fornares, and receipters, and fufteiners of thieft, in their wicked & odious crimes and deeds : I T I S ftatute and ordained, that ther be an roll and catalogue maid with all poflU ble diligence, of all perfons of the furnames forefaidis, fufpecled of flauchter, thieft, riefe, receipt of thieft , or thieves, or forning, within the faids Schireffedomes and Stewartries in quhat townes, and parochins, and under quhat Landes- lordes and Maifters or Baillies they dwell. THAT all Landis-lordes and Baillies be charged to finde fovertie, to relieve the King and Warden in the Bordoures, and over all quhair, to make their Bbb i men,
