IK ofAuguft, i6zi. 479 pretend ignorance of the fame : and to command , charge , and inhibite , all and fundry perfons , Inhabitants within the faid Burgh , of what Trade or Calling foever they bee : That they , or none of them , nor none j by their command , and direction , Found , build or keep any ftackes , or ruckes of Hather , Broome , Whinnes, or other fewel, within any of the Cloafles , Vennalles , or waft e places of die faid Burgh , nor with- in their houfes : And that they remove the ftackes which they already have , and build the fame at fome re- mote places , about the portes and walles of the faid Burgh, where there are no houfes , or at the North- Loch- fide : betwixt & the laid firft day of May , next to come : under the paine of confifcation of the fame Hather, j Broome,& Whinnes,fo to be ftacked,againft the meaning and intent of this Aft,and further: under the paine of five hundreth poundes, to be payed by them , fo oft as they {hall happen to fayle. And fuch like, to com- mand all and fundry Flefhours , Inhabitants within the faid Burgh , that they prepare themfelves of Slaugh- ! ter-houfes , at the North-Loch-fide : where they may have the commoditie of water for their ufe ; and ! that they in no wife prefume , nor take upon hand , after the faid day , to tuime the filth , or blood of their Slaughtered Goods upon the ftreetes, nor in the vennalles , cloafles, andwyndes of this Burgh. Asalfo, To charge all Candle-makers , That they, betwixt and the day forefaid , provide themfelves of houfes , for I melting of their Talione , and Cracklings, at fome remote partes of the Tovvne , from the common-ftreetes , cloafles, and vennalles of die fame : under the paine of five hundreth poundes money, to be incurred by every perfon, Flefhour, or Candle-maker , fo often as they fhall faile. AND fuch like, to command, and charge the Proveft and Bailhes of Edinburgh , That they have a fpecial care and regarde,to fee this prefent Act to be precifely and inviolably keept : as they will anfwere to His Majeftie , and the faids Lords , upon the duetiful difcharge of their Onice. ACT. XXX. t_A2l rejlrayning the buying and felling ofcertaine Wylde Fowles. OUR SOVERAIGNE LORD, with advice and confent of the ESTATES of Parliament , confidering the great abufe and libertie, which hath beene ufed thefe divers yeares by-gone, by the fubjefts of this Realme , in buying and felling of wylde fowles , of the particular fpecies following : to wit , Of Pouttes, Partriekes, Muire-foules , Blacke-cockes , Gray-hennes, Termigantes, Quaylhes, Capcr- kayllies , &c. For reftrayning of which abufe in time comming , OUR SOVERAIGNE LORD, with advice and confent forefaid , ftatutes and ordaines , That no perfon whatfoever within this Realme pre- fume , nor take upon hand , to buy nor fell , at any time hereafter, any Wylde-fowles of the fpecies forefaids, under the paine of ane hundred} pounds money, to be incured by the contraveener thereof, buyer or feller. AND Ordaines this prefent Aft to have the ftrenth and force of ane Aft of Parliament , to be inviolably obferved in all time hereafter, aye, and wbille the lame be lawfully difcharged , or altered. O ACT. XXXI. knent Hunting , andHaulking. UR SOVERAIGNE LORD, And ESTATES of this prefent Parliament, ftatutes and or- daines , That no man Hunt nor Haulk at any time hereafter , who hath not a Plough of land in Heritage, under the paine of ane hundreth pounds. ORDAINES His Majeftie to have the one halfe of the penal- tie of die Contraveeners of diis prefent Aft -. and the Dilator to have the other halfe of the faid penaltie. ACT XXXII. Knent the harrying of Haulke Neils , and hunting in Snow. OUR SOVERAIGNE LORD, And ESTATES of this prefent Parliament, Ratifies, and approves the Aft of Parliament , made by King J A M E S the T hird of worthy memorie , in the feavendi Parliament , 'anent the unlaw of ftealing of Haulkes , Houndes , Partriekes , and Duickes : in all and fundry points,heads, artickles,and claufes thereof: With this addition.that the paine and penaltie often pounds therein contained ; S H A L L BE Now & in all time comming augmented againft the contraveeners of the faid Aft : under the paine of ane hundreth pounds money of diis Realme. AND ALSO, ratifies , and approves, all Aftes of Parliament, made Ot before by His Majefties moft Noble Progenitours , anent the Haying and hunting of Hares , Does , and : Rhoes in time of fnow : And ftatutes , and ordaines the paine | and penaltie againft the contraveeners thereof: to be under the paine of ane hundreth pounds money ( toties , quoties ) as they fhall happen to contraveen the fame. And ordaines the one halfe of the paine to be incurred by the contraveeners of this prefent Aft , to be given to His Majeftie : and the other halfe to the perfons Dilators of the contraveeners of the fame. .
