A N D For the fpiritual-men and Burrowes parts of the fame taxation , That there mall be uplifted of everie Archbifhoprick , Bifhoprick , Abbacie, Pryorie, and other inferiour benefice, and of everie Frec-burgh within this Kingdome , at everie one of the faids fix termes payment, the juft taxation thereof , and as they have been accuftomed to betaxt unto in all time by-gone , whenfoever the Temporal-lands within this Kingdome were ftented to thirtie (hillings money the pound land of old extent. And the fame taxation to be payed at every one of the fix feveral termes above-written. AND FOR inbringing of the fpiritual-mens parts of the fame taxation, Ordains letters to be direct , charging all and fundrie Archbifhops , Bifhops, Abbots , Pryors , as likewife all Noblemen and others, in vvhofe favours the erection of any prelacie.or other inferiour benefice, or any part or portion thereof, be it in Lands, Kirks, or Teynds, Or in whole favours the patronage of any benefice. Kirks, or Teynds are paft , and all other beneficed perfons contained in the Taxt-rols, their heritable Baillies, Chamber- lanes , Factors and intromettors with their rents and living, perfonally , or at their dwelling places, and by open proclamation at the Market-erodes of the Head-burrowes of the Sheriffdomes , Srewartries , and Baillieries, where the faids Prelacies, erected Lordfhips, and fmall Benefices lye , if they be within this Kingdome. And if they be without this Kingdome, by open proclamation at the Market-ctofle of Edinburgh, Peir and Shore of Leith , upon threefcore dayes warning , to make payment of that fumme , that they and ilk one of them are taxtunto, for every one of the faids fix termes , To the Collector general of the laid taxation, appointed or to be appointed by his MAJESTIE, or his Deputes and Officers in his name , having his power and commiflion to receave the fame, at the particular termes above-written, under the paine of Rebellion, and putting of them to the home. And if they failie therein , at the by-palling of every one of the faids termes , To denounce the difobeyers rebels , and put them to the home , and to efcheat , &c. And that the Prelates, and beneficed perfons , andfuch Noblemen, and others , in whofe favours the erections and patronages above-written are paft , For their reliefe have ietters , charging their Vaflals , Sub-vatials, Ladies of terce, conjunct-feears , and life-renters, Fewars, Tackfmen, and penfioncrs , to make payment of their part ot the faid Taxation ilk one of them (fro rata) according to the fumme they (hall be taxt unto ; to the faids Pre- lates, and other beneficed perfons, and to the faids Noblemen, and others, having power to receave the fame, within twentie dayes next after the charge, under the paine of rebellion , &c. And if they failie, &c. To de- nounce, &c. and Efcheat, &c. And to poynd and diftrenyie therefore, as they (hall think moft expedient : Providing alwaies, that the firft termes payment of the faid taxation be ever paft , before the next termes pay- ment be charged for. And the Eftates declare , That the production of fufficient homings againft the faids
aflals, Fewars,Tackf-men and penfioners, ihall be a reliefe to the faids Prelates, Lords of erection, and bene-
ficed perfons, and mall exoner them (fro tanto) from payment of the faid taxation. Providing that the fame ihornings, with their Taxt-rols authentickly made and fubferibed by the faids Prelates, Lords of Erections, and other beneficed perfons, and by their Fewars, Vaflals, Tackf-men and Penfioners in manner hereafter pre- ferred , containing the particular fumme which each one of them are taxt unto , be delivered to the Collector of the fame Taxation , within the fpace of threefcore dayes after every Terme : Othervvife he fhall be no- wayes obliged to receave the fame, neither fhall the Prelate, Lord of erection, nor beneficed perfon be exo- I nered by production of the fame at any time thereafter. And farther, that the faids Prelates andfuch Noblemen, and others in whofe favours the Erections and Patronages above-written are paft , and all other beneficed perfons may have their reliefe of their Vaflals , Sub-vaflals, Ladies of terce , conjunct-feears, life-renters, Fewars, Tackf-men, and penfioners : To the I greater eafe , and lefle trouble to their faids Vaflals and others forefaid. And to the effect , that every one I proportionally may pay his part of the faid Taxation , according to the quantity and availe of the free-rent, which hee hath of his benefice, lands, penfions, Kirkes, and Teind-fheaves pertaining to him , alfwel Prelate, Lord of erection , Patron, and other beneficed perfons themfelves, as the Fevvar, Tackf-man and Penfioner. IT IS thought expedient , ftatute and ordained , that the faids Prelates and others above-rehearfed , every one of them feverally (hall conveen his whole Fewars , Vaflals, Tackf-men , and Penfioners at the par- ticular places hereafter defigned.
