And ficklike, ftatute and ordaine that all and whatfoever of the faid Clan-Gregour that mall happen to bee within the faidKingdome upon the fifteenth day of March next to come, fhall give their compearance before the Lords of privie Councel at Edinburgh, or where it mall happen them to bee for the time, or the next Councel day thereafter; To the effect that fuch of them as have alreadie found caution, and whofe cautioners are dead, may finde nevve caution for their good behaviour in time coming. And fuch of them who have never found caution, may finde caution ancHuretie for their obedience in time coming, with certification to them if they doe not com- peare, and that the Lords of privie Councel, for their difobedience, fhall direct letters of horning againft them, or any of them, and that they therefore be put to the home ; that then it fhall be lawful to any of his Majefties good Subjects , to take and apprehend them , where ever they may bee had, and put them to the next Sheriffe, Stewart, Bayliffe of regalitie, or their deputes ; To any of the Juftices of peace , or to the Provcft and BaylifFs of Burrowes, to the effect they may prefent them before the Lords of his Maiefties privie Councel, that fuch order may bee taken with the faid rebels, as the faid Lords fhall thinke expedient. And farther , our faid Soveraigne Lord declares, that if any of his Highnefie good fubjects fhall happen iri taking of the faid rebels , to hurt, mutilate or flay any of them, the parde who fliall happen fo to doe, and their complices, fliall no waves be fubjedt nor lyableto law therefore, norincurreanypaineorskaithein their bodie or goods; and fliall be free of all purfutc criminal or civil, to be intended againft them, at the inftance of his Highnefie Advocate, or any other partie: But the fame ihall beholden as good fervice done to his Majeftie. And likevvife, his Majeftie and Eftates forefaid, ftatute and ordaine, that if any of the faid Clan-Gregour, who fhall happen to have compeared, and found caution in manner above-fpecified , bee found mafterleffe in time coming, having neither poffeffions nor callings, whereupon to live, nor will not take them to fervice, That it fhall bee lawful to any of his Highnefie good fubjects to take and apprehend them, and prefent them to the nixt Sherife, Stewart, Bayliffe of Regalitie and their deputs, or to the Proveit and Bayliffes of Burrowes ; and that they may prefent them to the Lords, and others of his Highnefie Councel , there to bee taken order with , as they thinke meets And ficklike , his Majeftie and Eftates of Parliament , ftatute and ordaine I hat if any of the faid Clan-Gregour fhall happen to be put to the home by letters ci horning direct againft them bee made thereof by the Lords of Councel , for the caufe above-written .• And that publication the faid Lords, to all his Majefties Lieges, and at all places needful ; That then whatfoever perfon or perfons fhall receive, fupply, or intercommoun with the faid rebels, or any of them, orfupply them with meate, drinke, lodging, or weapons, directly or indirectly, or any other necefTaries , fhall be punifhed in their bodies, goods, and geare, as intercommoners with rebels and forners, conforme to the lawes of this Kingdome againft intercommoners and forners. And alfo his Maieftie with confent of the Eftates forefaid , ftatutes, and ordaines, and commands all Sheriffes, Stewarts, Provefts, Bayliffes of Burrowes, and Regalities, and all and fundrie his Majeftiesgood fubjects to affift and concurre with any of his Highnefs good fubjects, who ihall happen to be in purfute of the faid rebels. And ficklike, ftatutes and ordaines the faid Provefts, and Baylifles of Burrowes, and Baylirfes of Regalitie, to receive from the hands of his Highnefie good fubjects, the faid rebels, who fhall happen to be apprehended by them in manner forefaid , put, keepe, and deteine them in fute ward and firmance, aye and while they be prefent- ed before his Majefties Counfel, orjuftice. And laftly, his Majeftie and Eftates forefaid, f or fuppreffing of the faid lawleffe limmers and Clan ofMac-Gregour nominate and appoints the Sheriffes of the Sherifdomes oiTerth , 'Dumbartane, Angus, Mernes, Sterling, and Stewarts of the Stewartries of Stratheme, Monteith, Banffe, InnerneJJe, Elgin, and Forres, and their deputes, and the Shireffe of Cromartie and his deputes, and the Provefts and Bayliffes of the Burrowes there ; The Earles of Errole, Montros, At ho/, Perth, Tullibairdin: Sea-fort, Vicount oiStormonth, Lord Ogilvie; The Lairds of Glenurquhy , "Lawers, Gamtullie, Weymes,Glenlyon, Glenfalloch, Edinampl, Grant, or any of them, his Majefties Juftices in that part, for fetting, trying, and doing Juftice upon the faid rebels oi Clan-Gregour, or any of them and their complices, who fhall be apprehended by any of his Highnefie good fubjects, for theft, forning, orflaughter, with power to them to hold Courts, proceed and mini fter Juftice upon the faid rebels appre- hended, as laid is, as accords. And where ever his Majefties good fubjects fliall happen to apprehend any of the faid rebels forning, commiting theft or flaughter, and Ihall prefent them to the faid Lords of Coun- cel, Juftice or Juftice-general , or Commifiioners above-fpecified, or either of them, the doer of that fervice , fliall have for his reward , the moveable goods and geare of the offender , taken and prefented by him in manner forefaid.
