Parliament of Kills jamesthe Sixth, It is exprefly Statute and Ordained, thatnoSenatouroftheColledgeofJuflice, Or^ dinary , or Extraordinary , fhall fit or vote in the caufes of their Father , Brother , and Son. D O E T H with advice and confent of His Eftates of Parliament, STATUTE and ORDAIN, That this dedin- atourfliall for the future be farther extended to degrees ofaffinitie, as well as confanguinity , So that in all time coming , No Senatour of the Colledge of Juftice , Ordinary , or Extra-ordinary , fhall fit or vote in caufes .where die purfuer, or Defender, is either Father, Brother, or Son in Law to him; And alfo that he mall not fit, or vote, in anycaufe, where he is Uncle, or Nephew, to the purfuer, or Defender. AND it is hereby declared , That this Ad fhall be extended to the Lords of Privy Council , and Exchequer , and the Commiffioners of the Juftidary , and to all other Judges and Judicatures in the Kingdom.who may be declin- ed where they are related to the party Purfuer , or Defender , in the degrees forefaids. XIV. ACT Rejlraining the exorbitant expence of CMarriages , Baptifms, and Burials. September. 15. 168 1. om, OUR SOVERAIGNELOR D,Confidering the great hurt.and prejudice, arifing to this Kingdom by the fuperfluous expence beftowed at Marriages , Baptifms, and Burials. FOR reprefline'of which abufe in time coming , HIS MAJESTY with advice and confent of his filiates of Parliament DOES Statute and ORDAIN, That Marriages, Baptifms, and Burials, fhall be folemnized and gone about, in fober,and decent manner. AND that at Marriages, befides the married perfons,their Parents Children , Brothers, and Sifters, and the Family wherein they live, There mail not be prefect at any contrad of Marriage, Marriage, orln-fare, or meet upon occafion thereof , above four Friends on either fide' with their ordinary domeftick Servants , and that neither Bride groom , nor Bride, nor their Parents , or Relati- ons , Tutours , or Curatours , for them and to their ufe , fhall make above two changes of raiment that time, or upon that occafion. Certifying fuch perfons as fhall contravcen, if they be landed perfons They fhall be lyable in the fourth part of their yearly valued rent, and thofe who are not landed perfons in the' fourth part of their moveables, Burgefles, according to their condition and means , not exceeding five hundred merks Scots , and mean Craftfmen and Servants , not exceeding one hundred merks : And if their fhall be anv greater number of perfons then aforefaid , in any Houfe or Jnn , within Burgh, or fub-urbs thereof, or with- in two miles of the fame , where Penny-weddings are made, That the Mailer of the Houfe fhall be fined in the fumm of five hundred merks Scots. AND ItisSTATUT and ORDAINED, That at Bat>- tifms upon, that occafion, befides the Parents , Children, Brothers, and Sifters, and thofe of the Family ■ there fhall not be prefent above four Witnefles. AND FARTHER His Majefty with confent forefaid' .STATUTES, and ORDAINS, That their fhall not be invited to Burials, any grater number of oer- fons then thefe following, viz. To the Burial of Noblemen , and Bifhops, and their Wives, not above One hundred Noblemen and Gentlemen : To the Burial of a Baron of quality, not above Sixty', and other landed Gendemen , not above Thirty. And that theMourners at the Burials of Noblemen , and Bifhops and their Ladies , doe not exceed Thirty , and at the Burials of Privy Counfellers. Lords of Seffion , Barons' Provefts of Burghs, and their Wives , the number of Mourners, doe not exceed Twenty four, And at the Burials of all other Landed Gentlemen, and Citizens within Burgh, they doe not exceed the number of Twelve. And prohibits , and difcharges the ufmg , or carrying of any Pencils , Banners , and other Honours at Burials, except only the eight Branches to be upon the Pale, or upon the Coffin , where there is no Pale' Under the forefaids penalties refpedive , in cafe they contraveen. AND IT IS STATUTE AND ORDAINED, That there be no Mourning Cloaks ufed at Burialsmor at any other time.under the pain of One hundred pounds Scots.
