§ 28. was a foreign country, and if adequate pru-
tection is granted in the dominion to the
works of British subjects generally, an Order in Council may extend the benefit of the Act or any jDart thereof, and with or without con- ditions, to works first produced in the dominion.
It will be observed, however, that a self- governing dominion will be in a stronger position than a foreign country, in that sect. 23 is not applicable, and however harshly authors of the United Kingdom may bo treated in a self-governing dominion, the Crown has no power, as in the case of a foreign country, to exclude works first produced in the dominion from acquiring copyright under the Act by simultaneous j)ublication in the dominion, and within the limits of the Act.
