PUBLIC LAW 107-107—DEC. 28, 2001 115 STAT. 1191 SEC. 833. PERSONAL SERVICES CONTRACTS TO BE PERFORMED BY INDIVIDUALS OR ORGANIZATIONS ABROAD. Section 2 of the State Department Basic Authorities Act of 1956 (22 U.S.C. 2669) is amended by adding at the end the following: "(n) exercise the authority provided in subsection (c), upon the request of the Secretary of Defense or the head of any other department or agency of the United States, to enter into personal service contracts with individuals to perform services in support of the Department of Defense or such other department or agency, as the case may be.". SEC. 834. REQUIREMENTS REGARDING INSENSITIVE MUNITIONS. (a) REQUIREMENT TO ENSURE SAFETY.—(1) Chapter 141 of title 10, United States Code, is amended by inserting after section 2388 the following new section: "§ 2389. Ensuring safety regarding insensitive munitions "The Secretary of Defense shall ensure, to the extent practicable, that insensitive munitions under development or procurement are safe throughout development and fielding when subject to unplanned stimuli.". (2) The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 2388 the following new item: "2389. Ensuring safety regarding insensitive munitions.". (b) REPORT REQUIREMENT.— At the same time that the budgets lo use 2389 for fiscal years 2003 through 2005 are submitted to Congress under note, section 1105(a) of title 31, United States Code, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report on insensitive munitions. The reports shall include the following: (1) The number of waivers granted pursuant to Department of Defense Regulation 5000.2-R (June 2001) during the preceding fiscal year, together with a discussion of the justifications for the waivers. (2) Identification of the funding proposed for insensitive munitions in the budget with which the report is submitted, together with an explanation of the proposed funding. SEC. 835. INAPPLICABILITY OF LIMITATION TO SMALL PURCHASES OF MINIATURE OR INSTRUMENT BALL OR ROLLER BEARINGS UNDER CERTAIN CIRCUMSTANCES. (a) IN GENERAL.— Section 2534 of title 10, United States Code, is amended by adding at the end the following new subsection: "(j) INAPPLICABILITY TO CERTAIN CONTRACTS TO PURCHASE BALL BEARINGS OR ROLLER BEARINGS.— (1) This section does not apply with respect to a contract or subcontract to purchase items described in subsection (a)(5) (relating to ball bearings and roller bearings) for which— "(A) the amount of the purchase does not exceed $2,500; "(B) the precision level of the ball or roller bearings to be procured under the contract or subcontract is rated lower than the rating known as Annual Bearing Engineering Committee (ABEC) 5 or Roller Bearing Engineering Committee (RBEC) 5, or an equivalent of such rating;
