and ‘‘(ii) confor m to standards esta b lished by the S ec - retary through regulations or guidance. ‘‘( C ) REIM B URSEMENT.—State costs for pro v iding nutri- tion education under this subsection shall be reimbursed pursuant to section 16 (a). ‘‘( 4 ) NO TI F I CA TION.—To the ma x imum extent practicable , State agencies shall notify applicants, participants, and eligible program participants of the availability of nutrition education under this subsection. ’ ’. SEC.41 1 2 . T EC HNI C AL CLA R I F ICATI O NRE G AR D ING ELIGI B ILIT Y . Section 6( k ) of the F ood and Nutrition A ct of 20 0 8 ( 7U .S.C. 201 5 (k)) is amended— (1) by redesignating paragraphs (1) and (2) as subpara- graphs (A) and (B), respectively, and indenting appropriately; (2) by striking ‘‘No member’’ and inserting the follo w ing

‘‘(1) I N G ENERA L .—No member’’; and ( 3 ) by adding at the end the following: ‘‘(2) P ROCE D URES.—The Secretary shall— ‘‘(A) define the terms ‘fleeing’ and ‘actively seeking’ for purposes of this subsection; and ‘‘(B) ensure that State agencies use consistent proce- dures established by the Secretary that dis q ualify individ- uals whom law enforcement authorities are actively seeking for the purpose of holding criminal proceedings against the individual.’’. SEC. 411 3 . CLARIFICATION OF S P LIT ISS U ANCE. Section 7(h) of the Food and Nutrition Act of 2008 (7 U.S.C. 2016(h)) is amended by striking paragraph (2) and inserting the following: ‘‘(2) REQUIREMENTS.— ‘‘(A) IN GENERAL.—Any procedure established under paragraph (1) shall— ‘‘(i) not reduce the allotment of any household for any period; and ‘‘(ii) ensure that no household experiences an interval between issuances of more than 40 days. ‘‘(B) M ULTI P LE ISSUANCES.—The procedure may include issuing benefits to a household in more than 1 issuance during a month only when a benefit correction is nec- essary.’’. SEC. 4114. ACCRUAL OF BENEFITS. Section 7(i) of the Food and Nutrition Act of 2008 (7 U.S.C. 2016(i)) is amended by adding at the end the following: ‘‘(12) RECO V ERING ELECTRONIC BENEFITS.— ‘‘(A) IN GENERAL.—A State agency shall establish a procedure for recovering electronic benefits from the account of a household due to inactivity. ‘‘(B) BENEFIT STORAGE.—A State agency may store recovered electronic benefits off-line in accordance with subparagraph ( D ), if the household has not accessed the account after 6 months.
