(a)REP E ALOFLIM I T ATIO N.— ( 1 ) REPEAL.— Section 1 30 ao f tit l e10 ,U nite d State sC ode, is r e p ealed. ( 2 ) CLE R I C AL AMEN D MENT.— Th eta b le of sections at the be g inning of chapter 3 of s u ch title is a m ended b y stri k ing the item relating to section 130a. (b) REPORT RE QU IRED.—The Secretary of D efense shall include a report w ith the defense budget materials for each fiscal year that includes the following information
(1) The a v erage number of military personnel and civilian employees of the Department of Defense assigned to ma j or Department of Defense head q uarters activities for each compo - nent of the Department of Defense during the preceding fiscal year. (2) The total increase in personnel assigned to major head- quarters activities, if any, during the preceding fiscal year— ( A ) attributable to the replacement of contract per- sonnel with military personnel or civilian employees of the Department of Defense, including the number of posi- tions associated with the replacement of contract personnel performing inherently governmental functions
and ( B ) attributable to reasons other than the replacement of contract personnel with military personnel or civilian employees of the Department, such as workload or oper- ational demand increases. (3) An estimate of the cost savings, if any, associated with the elimination of contracts for the performance of major head- quarters activities. ( 4 ) The number of military personnel and civilian employees of the Department of Defense assigned to major headquarters activities for each component of the Department of Defense as of O ctober 1 of the preceding fiscal year. (c) DEFINITION S .— I n this section: (1) DEFENSE B UD G ET MATERIALS.—The term ‘ ‘defense budget materials ’ ’, with respect to a fiscal year, means the materials submitted to Congress by the Secretary of Defense in support of the budget for that fiscal year that is submitted to Congress by the P resident under section 110 5 of title 31, United States Code. (2) CONTRACT PERSONNEL.—The term ‘‘contract personnel’’ means persons hired under a contract with the Department of Defense for the performance of major Department of Defense headquarters activities. SEC. 90 2 . FLE X I B ILIT Y TO ADJUST THE NUMBER OF DEPUTY CHIEFS AND ASSISTANT CHIEFS. (a) ARM Y .—Section 3035(b) of title 10, United States Code, is amended to read as follows: 10USC2 21 note.
