and ‘‘(2) provides guidance and recommendations on how effec- tive model programs can be replicated. ‘ ‘ SEC.768 . RUL E OF CO N S T RUCT I ON. ‘‘Nothing in this subpart shall be construed to reduce or e x pand— ‘‘(1) the obligation of a State or local educational agency to provide a free appropriate public education, as defined in section 60 2 of the I ndividuals with D isabilities E ducation A ct; or ‘‘(2) eligibility re q uirements under any F ederal, State, or local disability law, including the Americans with Disabilities Actof1 9 90( 4 2 U .S. C . 12101 et seq.), the Rehabilitation Act of 19 73 (29 U.S.C. 701 et seq.), or the Developmental Disabil- ities Assistance and B ill of Rights Act of 2000 (42 U.S.C. 15001 et seq.). ‘‘SEC. 76 9 . A UT H ORI Z ATION OF A P PROPRIATIONS AN D RESER V ATION. ‘‘(a) A U T H OR IZA TIO N O F APPROPRIATION S .— T here are authorized to be appropriated to carry out this subpart such sums as may be necessary for fiscal year 2009 and each of the five succeeding fiscal years. ‘‘(b) RESER V ATION OF FUN D S.—For any fiscal year for which appropriations are made for this subpart, the Secretary shall reserve funds to enter into a cooperative agreement to establish the coordinating center under section 777(b), in an amount that is— ‘‘(1) not less than $ 240,000 for any year in which the amount appropriated to carry out this subpart is $ 8 ,000,000 or less; or ‘‘(2) equal to 3 percent of the amount appropriated to carry out this subpart for any year in which such amount appro- priated is greater than $8,000,000. ‘ ‘ Subpart3—Com m is sio n on Ac c e ssib l e M aterials
