(a) I N G ENE RAL .—Except as provided pursuant to subsection (b), effective as of October 1, 2012, each airborne intelligence collec - tion system of the D epartment of Defense that is connected to the Distributed C ommon Ground / Surface System shall have the capability to operate with the N etwor k -Centric Collaborative Tar- geting System. (b) E XC E P T IO NS.—The re q uirement in subsection (a) with respect to a particular airborne intelligence collection system may be waived by the Chairman of the J oint R equirements Oversight Council under section 1 8 1 of title 10, U nited States Code. W aivers under this subsection shall be made on a case-by-case basis. SEC. 22 1 . LIMITATION ON OBLIGATION OF FUN D SFOREN H ANCED AN / T P Q –36 RADAR SYSTEM PENDING SUBMISSION OF REPORT. Of the amounts appropriated pursuant to section 201(1) of this Act or otherwise made available for fiscal year 200 9 for research, development, test, and evaluation, Army, for the Enhanced AN/T PQ– 3 6 radar system, not more than 7 0 percent of the amounts remaining unobligated as of the date of the enactment of this Act may be obligated until the Secretary of the Army submits to the congressional defense committees a report describing the plan to transition the Counter-Rockets, Artillery, and M ortars pro- gram to a program of record. ANNUAL DIRECTOR OF OPERATIONAL TEST AND E V ALUA - TION CHARACTERI Z ATION OF OPERATIONAL EFFECTIVE- NESS , SUITABILITY, AND SURVIVABILITY OF THE BAL- LISTIC MISSILE DEFENSE SYSTEM. (a) ANNUAL C H ARACTERI Z ATION.—Section 232(h) of the National Defense Authori z ation Act for Fiscal Y ear 2002 (10 U.S.C. 2 4 31 note) is amended— (1) by redesignating paragraph (2) as paragraph (3)

(2) by inserting after paragraph (1) the following new para- graph (2)

‘(2) The Director of Operational Test and Evaluation shall also each year characterize the operational effectiveness, suitability, and survivability of the ballistic missile defense system, and its elements, that have been fielded or tested before the end of the preceding fiscal year. ’ ’; and (3) in paragraph (3), as redesignated by paragraph (1) of this subsection, by inserting ‘‘and the characterization under paragraph (2)’’ after ‘‘the assessment under paragraph (1)’’.
