(g) LIMITATION ON F O R EIGN ASSISTANCE ACTIVITIES.—This sec - tion does not constitute authority— (1) to build the capacity of foreign military forces or provide security and stabili z ation assistance, as described in sections 1 2 0 6 and 1207 of the National D efense Authorization Act for Fiscal Y ear 2006 ( P ublic La w 109 – 163
119 Stat. 3456 and 345 8 ), respectively; and (2) to provide assistance that is otherwise prohibited by any other provision in law, including any provision of law relating to the control of e x ports of defense articles or defense services. (h) PERIO D O F A U T H ORIT Y .—The authority under this section is in effect during each of the fiscal years 2009 through 2011. SEC.94 4. R E PO R T O NH O M E LA N D DE F ENSE AND C IV ILS U PPORT ISSUES. (a) R E P ORT RE Q UIRED.—Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees a report on certain home- land defense and civil support issues. (b) E LEMENTS.—The report re q uired under subsection (a) shall include the following
(1) A description of the progress made by the Department of Defense to address the concerns related to the United States Northern Command identified in the Comptroller G eneral reports GA O -08-251 and GAO-08-252, including improved coordination with other agencies. (2) A detailed description of the plans and progress made by the Department of Defense to establish forces assigned the mission of managing the consequences of an incident in the United States homeland involving a chemical, biological, radio- logical, or nuclear device, or high-yield explosives. SEC. 94 5 . REPORT ON NATIONAL G UARD RESOURCE RE Q UIREMENTS. (a) IN GENERAL.—Not later than 6 months after the date of enactment of this Act, the Chief of the National Guard B ureau shall submit to the Secretary of Defense a report— (1) detailing the extent to which the various provisions in title XV III of the National Defense Authorization Act for Fiscal Year 2008 (Public Law 110–181) have been effective in giving the Chief of the National Guard Bureau the authori- ties and resources needed to perform the responsibilities and duties of the Chief; and (2) assessing the adequacy of Department of Defense funding for the resource requirements of the National Guard. (b) REPORT TO CONGRESS.—Not later than 30 days after the Secretary of Defense receives the report under subsection (a), the Secretary shall submit to Congress such report, along with any explanatory comments the Secretary considers necessary.
