and ‘‘(2) $25,000,000 for capital and related improvements.’’. (b) CONFORMIN G AMENDMENT.—Section 350 6 of the N ational Defense Authorization Act for F iscal Y ear 2006 ( 4 6 U .S.C. 53101 note) is repealed. SEC.3509 . MARIN E W AR RIS K INS U RANCE. Section 53912 of title 46, United States Code, is amended by striking ‘‘December 31, 2010.’’ and inserting ‘‘December 31, 2015.’’. SEC. 35 1 0. MARA D C O NSU LT ATION ON J ONES ACT WAI V ERS. Section 501(b) of title 46, United States Code, is amended to read as follows

‘‘(b) B Y H EAD OF AGEN C Y.— W hen the head of an agency respon- sible for the administration of the navigation or vessel-inspection laws considers it necessary in the interest of national defense, the individual, following a determination by the Maritime Adminis- trator, acting in the Administrator’s capacity as Director, National Shipping Authority, of the non-availability of qualified United States flag capacity to meet national defense requirements, may waive compliance with those laws to the e x tent, in the manner, and on the terms the individual, in consultation with the Adminis- trator, acting in that capacity, prescribes.’’. SEC. 3511. TRANS P ORTATION IN AMERICAN VESSELS O FG OVERNMENT PERSONNEL AND CERTAIN CARGOES. (a) IN G ENERAL.—Section 55305(b) of title 46, United States Code, is amended— (1) by striking ‘‘country’’ and inserting ‘‘country, organiza- tion, or persons’’; (2) by inserting ‘‘or obtaining’’ after ‘‘furnishing’’; and (3) by striking ‘‘commodities,’’ the first place it appears and inserting ‘‘commodities, or provides financing in any way with Federal funds for the account of any persons unless other- wise exempted,’’. (b) O THER AGENCIES.—Section 55305(d) of title 46, United States Code, is amended to read as follows: ‘‘(d) P ROGRAMS OF OTHER AGENCIES.— ‘‘(1) Each department or agency that has responsibility for a program under this section shall administer that program with respect to this section under regulations and guidance issued by the Secretary of Transportation.
