SEC.9108 .S ANT A M A RG AR I TA RI V ER , CA L I FO RNIA. (a) D E F INITIONS.— I n this section
(1) DISTRICT.—The term ‘‘District’’ means the Fallbrook Public U tility District, San Diego County, California. (2) PRO J ECT.—The term ‘‘Pro j ect’’ means the impoundment, recharge, treatment, and other facilities the construction, oper - ation, watershed management, and maintenance of which is authori z ed under subsection (b). (3) SECRETARY.—The term ‘‘Secretary’’ means the Secretary of the Interior. (b) AUTHORIZATION FOR CONSTRUCTION OF SANTA M ARGARITA RIVER PROJECT.— (1) AUTHORIZATION.—The Secretary, acting pursuant to Federal reclamation law (the Act of J une 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act (43 U.S.C. 371 et se q .),tothee x tent that law is not inconsistent with this section, may construct, operate, and maintain the Project substantially in accordance with the final feasibility report and environmental reviews for the Project and this section. (2) CONDITIONS.—The Secretary may construct the Project only after the Secretary determines that the following condi- tions have occurred: (A)(i) The District and the Secretary of the N avy have entered into contracts under subsections (c)(2) and (e) of section 9 of the Reclamation Project Act of 1939 (43 U.S.C. 48 5 h) to repay to the United States equitable and appro- priate portions, as determined by the Secretary, of the actual costs of constructing, operating, and maintaining the Project.
