(c) EF FECTI V E D ATE.—The amendments made by this section shall take effect on O ctober 1, 200 9 , or the date of the enactment of this Act, whichever is later. SEC.913 . MAN A G EMEN T AN DFU ND I NG ST R ATEG Y AND IM PL EMENTA - TI O NPLANFORT H E NATIONAL POLAR-OR B ITING OPER- ATIONAL EN V IRONMENTAL SATELLITE SYSTEM PROGRAM. (a) M ANA G EMENT AND FU NDING STRATEG Y .— (1) I N GENERAL.—The P resident shall develop a strategy for the management and funding of the N ational Polar-Orbiting Operational Environmental Satellite System Program (in this section referred to as the ‘ ‘Program’’) by the Department of Defense, the Department of Commerce, and the National Aero- nautics and Space Administration. (2) ELEMENT S .—The strategy re q uired under paragraph (1) shall include the following: (A) R equirements for the Program. ( B ) The management structure of the Program. (C) A funding profile for the Program for each year of the Program for the Department of Defense, the Depart- ment of Commerce, and the National Aeronautics and Space Administration. (b) IM P LEMENTATI O N PLAN.—The President shall develop a plan to implement the strategy required under subsection (a)(1). (c) L IMITATION ON U SE OF FUNDS.—Of the amounts authori z ed to be appropriated for fiscal year 2010 by section 201(a)(3) for research, development, test, and evaluation for the Air Force and available for the Program— (1) not more than 50 percent of such amounts may be obligated or e x pended before the date on which the strategy developed under subsection (a)(1) is submitted to the congres- sional defense committees, the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Science and Technology of the H ouse of Representatives

and (2) not more than 75 percent of such amounts may be obligated or expended before the date on which the plan devel- oped under subsection (c) is submitted to the congressional defense committees, the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Science and Technology of the House of Representatives. (d) SENSE OF CONGRESS.—It is the sense of Congress that once all requirements for the Program are fully agreed to by the Secretary of Defense, the Secretary of Commerce, and the Adminis- trator of the National Aeronautics and Space Administration, the Program should be executed with no modifications to those require- ments that would increase the cost, or extend the schedule, of the Program.
