(b) COMPLIANCEW I TH LA W APPLICA B LE TO MU LTI Y EA R CON- TRACT S . — Any contract entered into under subsection (a) shall be entered into in accordance with the provisions of section 230 6 c of title 10 ,U nited States Code, e x cept that— (1) the term of the contract may not be more than 8 years; and (2) notwithstanding section 2306c(b) of such title, the authority under section 2306c(a) of such title shall apply to the fee-for-service air refueling pilot program. (c) COMPLIANCE WITH LAW APPLICABLE TO SER V ICE CON- TRACTS.—A contract entered into under subsection (a) shall be entered into in accordance with the provisions of section 2 4 01 of title 10, United States Code, except that— (1) the Secretary shall not be required to certify to the congressional defense committees that the contract is the most cost-effective means of obtaining commercial fee-for-service air refueling tanker aircraft for Air Force operations; and (2) the Secretary shall not be required to certify to the congressional defense committees that there is no alternative for meeting urgent operational requirements other than making the contract. (d) LIMITATION ON AMOUNT.— T he amount of a contract under subsection (a) may not exceed $9 99,999,999. (e) PROVISION O FG OVERNMENT I NSURANCE.—A commercial air operator contracting with the Department of Defense under the pilot program referred to in subsection (a) shall be eligible to receive Government-provided insurance pursuant to chapter 443 of title 49, United States Code, if commercial insurance is unavail- able on reasonable terms and conditions. SEC.1083 . DI SC LO S UR EO FNAM ESOFS T UDENTS AND INSTRUCTORS AT W ESTERN H EMIS P HERE INSTITUTE FOR SECURIT Y COOPERATION. (a) DISCLOSURE.— (1) IN G ENERAL.—The Secretary of Defense shall release to the public, upon request, the information described in para- graph (2) for each of fiscal years 2009 and 2010. (2) CONTENT.—The information to be released under para- graph (1) shall include, with respect to the fiscal year covered, the entire name, including the first, middle, and surnames, with respect to each student and instructor at the Western H emisphere Institute for Security Cooperation. (b) WAIVER.—The Secretary of Defense may waive the require- ment under subsection (a) if the Secretary determines it to be in the national interest. SEC. 108 4 . SENSE OF CON G RESS REGARDING THE WESTERN HEMI - SPHERE INSTITUTE FOR SECURITY COOPERATION.
