(ii) does not result in significant incremental adverse effects on public health or the environment; and (iii) does one or more of the following

( I ) generates electricity or useful thermal energy from a renewable resource; (II) substantially increases the energy effi- ciency of buildings, industrial, or agricultural proc- esses, or of electricity transmission, distribution, or end-use consumption; or (III) substantially increases the energy effi- ciency of the transportation system or increases utili z ation of transportation fuels that have lifecycle greenhouse gas emissions that are substantially lower than those attributable to fossil fuel-based alternatives. P ROH IB ITION ON PRO M OTION O F TOBACCO S EC. 7082 . N one of the funds provided by this A ct shall be available to promote the sale or e x port of tobacco or tobacco prod- ucts, or to see k the reduction or removal by any foreign country of restrictions on the marketing of tobacco or tobacco products, except for restrictions which are not applied e q ually to all tobacco or tobacco products of the same type. COMMERCIAL LEA S ING OF D EFENSE ARTICLES SEC. 708 3 . Notwithstanding any other provision of law, and sub j ect to the regular notification procedures of the Committees on Appropriations, the authority of section 23(a) of the Arms E xport Control Act may be used to provide financing to Israel, Egypt and NAT O and major non-NATO allies for the procurement by leasing (including leasing with an option to purchase) of defense articles from U nited States commercial suppliers, not including M ajor D efense Equipment (other than helicopters and other types of aircraft having possible civilian application), if the P resident determines that there are compelling foreign policy or national security reasons for those defense articles being provided by commercial lease rather than by government-to-government sale under such Act. (a) In furtherance of the National Strategy to Inter- nationalize Efforts Against K leptocracy and Presidential Proclama- tion 77 5 0, the Secretary of State shall compile and maintain a list of officials of foreign governments and their immediate family members who the Secretary has credible evidence have been involved in corruption relating to the extraction of natural resources in their countries.
