Cvutwcts vn Sec. 11. And be it farther enacted, That all contracts on account of
the institution shall be made by the superintendent, and, when approved
mime. by the trustees, if their by-laws shall require their approval, shall be bind- _ ing in law, and the superintendent, or his successor, may sue or be sued S“‘”· thereon to final judgment and execution; and no suit shall abate by reason of the odlce of superintendent becoming vacant during the pendency of such suit, but any successor in the office shall assume the prosecution or defence of any pending suit, and continue the prosecution or defence until such suit shall be concluded. jlfrnstecsto Sec. 12.
