That the Secretar of War is hereby directed to serve upon m. dm, m` the said Delaware Railroad Company and its lessee in the manner r prescribed by the laws of the State of Delaware for the service of papers u on corporations, a notice m writing, requiring said company or ds lessee, within three months from the time of such notice, to remove said obstruction by placing in said bridge and maintaining therein a draw of sumcient width and dimensions to admit the free and easy passage of all steam-boats and other vessels navigating said stream and in case of refusal or neglect of said railroad company or its lessee to place in said bridge a suitable draw as required by the aforesaid notice, the Secretary of War is herebdy authorized and directed to cause a draw to be placed therein, an the cost and expense of such draw shall be a legal charge against the said railroad company and its lessee. That such sum of money as may be necessary to execute the provisions of this act by the Secretary of War is_l1ereby appropriated, out of any money in the Treasury of the United States not otherwise a propriated, to be paid out on the requisition of the Secretary of Véar.
