CHAP. 804.-An Act To amend chapter two of the law passed by the first session June 6, 1900. of the Fifty-fifth Congress of the United States, being an Act entitled "An Act * — making appropriations for sundry civil expenses of the Govemment for the fiscal year ending June thirtieth, eighteen hundred and ninety-eight, and for other purposes," approved June fourth, eighteen hundred and ninety-seven. , Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That chapter two of the laws §“;’,§,f,;:}*'§éd me of the first session of the Fifty~fifth Congress, being an Act entitled ¤fdPe¤d,e¢c.. timber. "An Act makin a propriations for sundry civil e euses of the ,¤l2?,lied?°’ p‘ 35 Government for tie fiscal year ending June thirtieth, eixgteen hundred and ninety-eight, and for other purposes,” approved June fourth, eighteen un§red and ninety-seven, be, and the same is hereby, amended by striking out the following words where the same appear in said Act, commencing with the word "Before," in line thirty-six, on page thirty-Eve of volume thirty of the United States Statutes at Large, and ending with the word "exists," in the forty-third line of said volume and a e, as follows: “Before such sale s all take place notice thereof shiad be iven by the Commissioner of the General Land Office, for not less tgan sixty days, by publication in a newspaper of general circulation published in the county in which the timber is situated, if any is therein published, and if not then in a newspaper of general circulation publis ed nearest to the reservation, and also in a newspaper of general circulation published at the capital of the State or Terr1tory w ere such reservation exists," and insert in lieu thereof the following: “Before such sale shall take place notice thereof shall N¤¤¤¤ ¤f webe given by the Commissioner of the Genera Land Office, for not less than thirty days, by publication in one or more newspa ers of general circulation, as he may deem necessar , in the State or 'lierritory where such reservation ex1sts: Provided, iirowever, That in cases of unusual Qggmency em emergency the Secretary of the Interior may, in the exercise of his sales ingadvanhe df discretion, permit the purchase of timber and cord wood in advance “‘"°"‘S°"?°“°· of advertisement of sale at rates of value approved by him and subject to payment of the full amount of the'hi hest bid resulting from the usual advertisement of sale: Provided further, That he may, in his discretion, sell without advertisement, in quantities to suit applicants, at a fair ap raisement, timber and cord wood not exceeding in value one hundred) dollars stum a e: And provided furtfzer, That in cases bi§¤v¤t¤_¤¤}¤ when in which advertisement is ha%l and no satisfactory bid is received, or stc,u°s°"° “°t°"’ in cases in which the bidder fails to complete the purchase, the timber , may be sold, without further advertisement, at private sale, in the discretion of the Secretary of the Interior, at not less than the ap raised valuation, in quantities to suit purchasers: And provided jiitrtlwr, That the provisions of this Act shall not apply to existing forest m$§f,<}jgj,°;exf,gl{,$3§,* reservations in the State of California, or to reservations that may be ` hereafter created within said State."
