Cris. 344, 345. 1901. 763 CHAP. 344.-jAn Act Permitting; the building of two dams across the Savannah F¤b¤‘¤¤1'Y $. 1901- River above the city of Augusta in the State of eorgia. 1"`_ Be it enacted by the Senate and House of Representatives of the United _ States of America in Congress assemb , That the consent of Congress cO'L§§u Olga Pigg is herebg granted to Twin City Power Company, a corporation organ- Sevenneh Riirer at ized un er the laws of the State- of South Carolina, its successors or D°”°°°° °'°°k‘ S' °‘ assigns, to construct, erect, and maintain a dam across the Savannah A River at or near where Dortons Creek, in the county of Edgeiield, State of South Carolina, empties into the Savannah River, and all works incident thereto in the utilization of the power thereby developed; and also a dam across the said river at or near the southern end -tg1¤¤¤¤Price¤1s1e¤d. o Prices Island in said river, and about five miles from the mouth of ° ' Dortons Creek, and all works incident thereto in the utilization of the power thereby developed: Provided, That each of the dams constructed %g~»¤- shall be provided with an accessible lock of such cwcity as may be ‘ prescribed by the Secretary of War: Provided also, at the plans for a Sécrggavy ¤f Viper w the construction and maintenance of said, dams and aEpurtenant works pm P °us’° °' shall be submitted to and a proved by the Chief of ngineers and the ‘ Secretary of War before the commencement of the construction of such dam or dams, and that the said Twin City Power Company shall not deviate from such plans after such apdproval, either before or after completion of the same, unless the mo itication of said plans shall have previously been submitted to and received the approval of the Chief of Engineers and of the Secretary of War: Provided farther, That in case any litigation arises from the building of said dam or Litigation. dams, the- maintaining of the same, or from the obstruction of said river by the said dam or dams or appurtenant works, cases may be tried in the proper courts as now provided for that purpose in the gtates of South Carolina and Georgia, and the courts of the United tates. . Sec. 2. That the 1`ighb to amend or repeal this Act is herebv Amendment expressly reserved: And provided further, That suitable fishways shall {vignebe constructed and maintained at said dams by said company, its suc- wm" cessors and assigns, as may be required from time to time by the United States Fish Commissioner. · A Sec. 3.
