Be it enacted by the Senate and Hbuslzcif Representatives of the United States of America in Congress assemb , That the Carolina Northern R,§f_(‘;,{§;¤;¤g°@$ Railroad Company a co1§oration created and existing under an act of Lumberguversznumthe general assembly of orth Carolina, be, and is hereby, authorized °°"°"’I"°‘ ` to construct and maintain a railroad bridge for the passage of railway enlgines and cars across the Lumber River `at suc point as may be se ected by such company and approved by the Secreta of War · within the boundary lines of Robeson County, North Cardiina, in or‘ near the town of Lumberton: Provided, That said ·bridge shall not be §g§_¤¤g%c constructed within one mile of any other bridge across said stream; ’ ° said bridge to be so constructed as not to obstruct the navigation of said river and to be provided with a suitable draw: Provide furt}ier, That any bridge constructed under this Act and accordin to its limi- I&¤wf¤1 getwcrurc tations shall be a lawful structure and shall be known and recognized °° p°°° mu ' as a post route, and the same is hereby declared to be a post route, upon which, also, no higher char e shall be made for the transportation over the same of the mails, axe troops and munitions of war of the United States than the rate per mile paid for transportation over . railroads or public highways lea ing to the said bridge, and the United P°¤”¤l *¢l¢¢=¤P¤· Etages shall gave the right of way for a postal telegraph across said 1'1 e. · S1§J. 2. That the bridge authorized to be constructed under this Act a $°:0*$g¤;{,_gg.W¤ *0 shall be located and built under and subject to such regulationsnfor the PP ` security of the navigation of said river as the Secretary of War shall ggescribe; and the said company or corporation shall submit to the cretary of War, for his examination and approval, a design and drawing of the proposed bridge and a map of the location giving, for the space of one—fourth of a mile above and one—fourth of a mile below the roposed location, the topography of the. banks of the river, ° the shore lines at high and low water, the direction and strength of the currents, and the soundings, accurately showing the bed of the stream, and shall furnish such other information as may be required for a full and satisfactory understanding of the subject; and until the said plan and locationmof the brid e are approved by the Secretary of ‘ War no work upon the bridge sgall be commenced; and should any Ghww change be made in the plan of said bridge during the progress of construction such changie s all be subject to the approval of the Secretary of War: Provided, `hat nothing in this Act s all be construed as to lawmm repeal or modify any of the provisions of law now existing in refer- puree. ence to the pr0tection of the navigation of rivers, or to exempt this bridge from the operations of the same. _ Sec. 3.
