104 Firrr-snvmrru coucnnss. sm. 1. cm. 504, 505. 1902. whenever said bridge shall, in the opinion of the Secretary of War, substantially obstruct the free navigation of said river, he is hereby , authorized to cause such change or alteration of said bridge to be made as will obviate such obstruction, and all such alterations shall be made and all such obstructions shall be removed at the expense of the owner or owners of said bridge, or the persons operating or controlling the L***S¤“°¤· same, and in case of any litigation arising from any obstruction or alleged obstruction to the free navigation of the Missouri River, at or near the crossing of said bridge, caused thereby, the cause shall be commenced and tried in the circuit court of the United States of either judicial district of the States of Kansas or Missouri in which said h bridge or any portion of such obstruction touches. ¤gh°Zi_°g"p°°°°` Sec. 7. That the bridge shall be so constructed by draws n or lift span or otherwise that a free and unobstructed passage mayrm secured to all vessels and other water craft navigatin said river. That any bridge constructed under this Act shall be buih and located under and subject to such regulations for the security of the navigation of said river as the Secretary of War shall prescribe; and to secure that object the said company shall submit to the Secretary of War, for his examination and approval, the desi and drawings of the bridge, piers, and approaches, and a map of theilnocation, giving, for the space of at least one mile above and one mile below the proposed location, the topography of the banks of the river, the shore lines at hicrh and low water, and the direction and strength of the currents at all stages, and the soundings, accurately showing the bed of the stream, and the location of other bridge or bridges, wharves, landings, or ferries, and shall furnish such other information as shall be required for a full and satisfactory understanding of the subject: and until said plan and location of the bridge are approved by the Secretary of War the bridge shall not be commenced or built, and after such approval b the Secretary of War the approved plans and designs for the bridge shall not be
