[rubiic, No. 154.] Be it enacted by the Senate and House of Representatives 0 f t/ie United States of America in Congress assembled, That upon the payment by §'E$ig§}},,yS Fam the State of Michigan of sixty-eight thousand nine hundred and twenty— Shiv Q·¤¤¤!» ¤¤¤¤¤— seven dollars and twelve cents into the Treasury of the United States, g>iiiii(tr.°mm °° W · the Attorney-General be, and is hereby, authorized to settle and dismiss from the Supreme Court of the United States a suit in equity now pending therein in whichthe United States is complainant and the State of Michigan is defendant, and to relinquish all further claims against said State, including interest upon said amount, which have arisen by reason of its trust in constructin and operating Saint Marys Falls _ Ship Canal and locks: Ibn/vided gfhat such payment is made within {,°§;,'f_f§,,,_ ninety days from the passage and approval of this Act. [Public, No. 156.] Be it enacted by the Senate amt &ztse of Representatives 0 f the United States 0 f America in Congress assembled, That the Chicago, Milwaukee B;g"r§,ft*;g{lhi*{,Q*l{:"Y and Saint Paul Railway Company, of Montana, a corporation created chicago, fnnwhu. under and by virtue of the laws of the State of Montana, be, and the §°§’i{‘$,yS°§'gL;{{,"; same is hereby, empowered to survey, locate, construct and maintain $\Qg*}1“¤h* °* WY a railway, telegrap , and telephone_ line through Fort Keogh Military ` Reservation, Montana, upon such a line as may be determined and approved by the Secretary of War. _ Sec. 2. That said corporation is authorized to take and use for all ”°“°"’“°“°‘$°‘“'· purposes of a railway, telegraph, and telephone line, and for no other urpose, a right of way one hundred feet in width through said Fort Ss-nogh Military Reservation, and a right to take and use a strip. of land in said reservation two hundred feet in width, with a lengt of three thousand feet, in addition to said right of way, for stations, station grounds, and stock vards, with the right to use other additional ground, when cuts and fills may be necessary for the construction and maintenance of said roadbed, not exceeding one hundred feet in width on each side of said right of way, or as much thereof as may be included in said cut or tid: Ibvvided, That no part of the lands herein Q§f{Qg0n_ authorized to be taken shall be used except in such manner and for such purposes as shall be necessary for the construction and convenient operation of said railway, telegraph, and telephone lines and the use _ and enjoyment of the rights and privileges herein granted; and when R°"°“‘°“· an y portion thereof shal cease to be so used such portion shall revert to the United States, from which the same shall be taken: Pmvidedfur- mg;“°°° ’*”“ °’°”* Mer, That the Chicago, Milwaukee and Saint Paul Railway Company, of Montana, will fence its right of wav, and will rovide and maintain _ necessary and suitable crossings: And provided_flbv·t/ter, That the said “°‘“”’“°“’· Chicago, Milwaukee and Saint Paul Railway Company, of Montana, shall comply with such other regulations or conditions as may from time to time be prescribed by the Secretary of W'ar.
