CHAP. 204.-Joint Resolution Providing for the observance and commemo- rati on of th e one hu ndred a nd seven ty-fifth anniver sary of the Battle of the Mon ongahela , and es tablish ing a co mmission to be known as the Uni ted Stat es Battle of the Monongahela Commission . Resolved by the Senate and House of Representatives of the Un ited S tates of America in Congress assembled, That there is hereb y established a commission to be known as the Battl e of the Monongahela Commission (hereinafter referred to as the commis- sion) and to be composed of five commissioners as follows : One person to be appointed by the President of the United States, two Senators by the President of the Senate, and two Members of the House of Representatives by the Speaker of the House of Repre- sentatives . Any vacancy in the office of a commissioner shall be filled in the same manner as the original appointment . The com- missioners shall serve without compensa tion therefor from the United States . The commission shall select a chairman from among its members . SEC. 2. The commission is authorized to arrange, in cooperation with any organization or society without cost to the United States, an ap propriate obs ervance and c ommemoration to take plac e in the month of July, 1930, of the one hundred and seventy-fifth anniver- sary of the Battle of the Monongahela, referred to as " Braddock's Defeat," and to participate on behalf of the United States, in such manner as it deems advisable, in any ot her observance or celebration of such anniversary which may be held in the United States during the year 1930 . CHAP . 205 .-An Act To a mend se ctio n 43 of the Act of May 25, 1 926, ent itled "An Ac t to a djust water- right charge s, to grant certai n othe r reli ef on the Federal irrigation projects, and for other purposes . Be it enacted by the Senate and House of Representatives of the United States o f America in Congress assembled , That section 43 of the Act of May 25, 1926, entitled "An Act to adjust water-right charges, to grant certain other relief on the Federal irrigation proj- ects, and for othe r purposes" ( Forty-fourth Statutes, pa ge 636), be, and the same is hereby, amended to read as follows : " SEC. 4 3 . The payment o f all constru ction charges against sai d areas temporarily unproductive shall remain suspended until the Secretary of the Interior shall declare them to be possessed of suffi cient productive power properly to be placed in a paying class, whereupon payment of construction charges against such areas shall be resumed or shall begin, as the case may be . An y pay ments made on such areas shall be credited to the unpaid balance of the con- struction charge on the productive area of each unit. Such credit shall be applied on and after the passage and approval of this Act, which shall not be construed to req uire revision of accounts her eto- for e adjusted un der the provi sions of this section as originally enacted . While said lands so classified as temporarily unproductive and the construction charges against them are suspended, water for irrigation purposes may be furnished upon payment of the usual operation and maintenance charges, or such other charges as may be 249 April 21, 1930 .
