PROCLA~L\ TIOXS, 1930. as to allow the State of South Dakota in furtherance of the aforesaid agreement to make selections of the lands agreed upon for selection and hereinafter described; and WHEREAS it appears that the Pllblic interests will be promoted by the elimination from the Custer National Forest of certain scattered tracts of alienated lands not suitable for forestry J>urposes; N ow, THEREFORE, I, HERBERT HOOVER, PreSident of the United States of America, do also proclaim. by virtue of the power in me vested by the act of March 3, 1891 (26 Stat. 1095), and by the act of June 4, 1897 (30 Stat. 11 at 34 and 36), that the above-mentioned proclamation and Executiv-e order are hereby modified so as to admit of the immediate selection by the State of South Dakota in furtherance of the above-mentioned agreement of Nov-ember 5, 19281 of the areas first hereinafter described within the said Custer ana Harney National Forests: BLACK HILLS ~IERIDIAN InT.17N., R.1E., secs.25and36; InT.16N., R.2E., E.~and~.~XW.7~sec.16; InT.16N., R.3E., secs. 1,2,and3; InT.17N., R.3E., S.~SW.7~andSW.;~SE.7~sec.25,·W. Xand W. ~ E. Xsec. 36; InT.16N., R.4E., W.~sec.6; InT.2S., R.5E., W.~sec.28,~. ~X.~sec.32,W.7~andSE. X sec. 33, and the unalienated portions of secs. 29, 30, and the N.~ofsec.31; and also by the elimination hereby from the Custer X ational Forest of the followin~ described l~ds: InT.16N., R.2E., NE.Xsec. 4; InT.17N., R.2E., E.~SE.Xsec. 19,NW.7~SW.7~andSE.74 SW. Xsec. 27, SE. XNE. X, E. ~ SE. Xand NW. XNW. 7~ sec. 28,E. ~NE. XandSW. XNE. Xsec. 30; InT.17N.,R.3E.,E.~E.~sec.36. Providt,d, That all selections by the State of South Dakota here- under must be filed within ninety days from the date of this procla- mation, or within ninety days from the filing of the plat of survey of any unsurveyed lands embraced within the areas to be selected by the State and the lands embraced in selections made by the State of South Dakota hereunder, to the extent that such selections receive the final approval of the Secretary of the Interior, be, and the same are, hereby declared eliminated from the Custer and Harney National Forests, such eliminations to become effective from the date of such approval.
