. [S . 2887.] construct, maintain, and oerate a toll bridge across the Ohio Rir at or ear [Pu[Public, No. 426.] Cannelton, Indiana . Be it enacted by the Senate and House o f Representatives of the United States o f America in Congress assembled, That in order to O Perry hio County, Ind ., promot e inters tate co mmerce, improve the Pos tal Ser vice, a nd pro- m ay brid ge, at Can nel- vide for military and other purposes, t he Perry County Bridg e Commission of Perry County, Indiana, be, and is hereby, authorized to construct, maintain, and operate a bridge and approaches thereto across the Ohio River, at a point suitable to the interests of naviga- tion, at or near Cannelton, Indiana, in accordance with the provisions of the Act entitled "An Act to regulate the construction of bridges volX34 p.1884. over navigable waters", approved March 23, 1906, and subject to the U. s.C.,p» 1474 . conditions and limitations contained in this Act . SEC . 2 . There is hereby conferred upon the Perry County Bridge Acquisition of ap- Commission all such rights and powers to enter upon lands and to proaches, etc . acquire, condemn, occupy, possess, and use real estate and other property needed for the location, construction, maintenance, and operation of such bridge and its approaches, as are possessed by rail- road c orporati ons for railroa d purpo ses or b y bridg e corpo rations for bridge purposes in the State in which such real estate or other property is situated, upon making just compensation therefor, to be ascert ained an d paid accordin g to th e laws o f such State, and the proceedings therefor shall be the same as in the condemnation or ex p ropriation of property for public _purposes in such State . SEC . 3 . The said Perry County ridg e Co mmiss ion is h ereby Toll charges .. authorized to fix and charge tolls for transit over such bridge, the rates of toll so fixed shall be the legal rates until changed by the Secretary of IV, ar under the authority contained in the Act of March 23, 1906. SEC . 4 . In fixing the rates of toll to be charged for the use of such Tolls to be applied to bridge, the same shall be so adjusted as to provide a fund sufficient etc . peration,sinkingfund, fund to pay for the reasonable cost of maintaining, repairing, and operat- ing the bridge and its approaches under economical management, and to provide a sinking fund sufficient to amortize the cost of such bridge and its approaches, including reasonable interest and financ- ing cost, as soon as possible, under reasonable charges, but within a period of not to exceed twenty years from the completion thereof . After a sinking fund sufficient for such amortization shall have been maintenance as free so provided, such bridge shall thereafter be maintained and oper- brid ge

amortizing ated free of t olls, or the rates of tol l shall thereafter be so adjusted as to provide a fund of not to exceed the amount necessary for the proper maintenance, repair, and operation of the bridge and its app roac hes u nder eco nomic al m anag ement . An accurate record of Records. the cost of the bridge and its approaches, the expenditures for main- taining, repairing, and operating the same ., and of the daily tolls collected shall be kept and shall be available for the information of all per sons inte reste d . SEC. 5 . The right to alter, amend, or repeal this Act is hereby Amendment . expressly reserved . Approved, January 27, 1936 .
