54 STAT.] 76H CONG., 3D SESS.-CHS. 7, 8-JAN. 17, 1940 [CHAPTER 7] 1243 AN ACT January 17, 1940 For the relief of the estates of Marie R. Morkovsky and Alphons Morkovsky, [H. R. 4813] both deceased. [Private, No. 268] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Treasury be, and he is hereby, authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, to the administrator of the estate of Marie R. Morkovsky, deceased, formerly of Hallettsville, Texas, the sum of $500; and to the admin- istrator of the estate of Alphons Morkovsky, deceased, formerly of Hallettsville, Texas, the sum of $5,000 in full satisfaction of all claims against the United States for the deaths of Marie R. Mor- kovsky and Alphons Morkovsky, which resulted from a collision between the automobile in which they were passengers and a United States Army truck, on November 9, 1937, near Luling, Texas: Provided, That no part of the amount appropriated in this Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or attorney on account of services rendered in connection with this claim, and the same shall be unlawful, any contract to the contrary notwithstanding. Any person violating the provisions of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000. Approved, January 17, 1940. [CHAPTER 8] AN ACT For the relief of Major Noe C. Killian. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Treasury be, and he is hereby, authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, to Major Noe C. Killian, United States Army, retired, the sum of $435 in full satisfaction of his claim against the United States for refund made by him to the War Department as a result of overpayments of an allotment in the case of Private Frank Frolla which were not discovered until after the soldier's discharge, said overpayments having been caused by alleged failure of Major Killian to send in the proper request for discontinuance to the zone finance officer, Wash- ington, District of Columbia: Provided, That no part of the amount appropriated in this Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or attorney on account of services rendered in connection with this claim, and the same shall be unlawful, any contract to the contrary notwithstanding.
