Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Treasury be, and he is hereby, authorized and directed to pay, out of any money in the Treasury of the United States not otherwise appropriated, to James Henry Rigdon, of Pickens, South Carolina, the sum of $3,500, in full settlement of all claims against the United States on account of the loss of his left arm and other bodily injuries and damages sustained by him by reason of the negligent and reckless operation of a United States Government truck operated in connection with Civilian Conservation Corps activities of the War Department, on a public highway near Pickens, South Carolina, on September 24, 1937: Provided, That no part of the amount appro- priated in this Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or attorney on account of services rendered in connection with this claim, and the same shall be unlawful, any contract to the contrary notwithstanding. Any person violating the provisions of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000. Approved, April 18, 1940. [CHAPTER 114] AN ACT For the relief of Howard Daury. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That sections 17 to 20, inclusive, of the Act entitled "An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes", approved Sep- tember 7, 1916, as amended (U. S. C., 1934 edition, title 5, secs. 767 and 770), are hereby waived in favor of Howard Daury, of Pittsfield, Massachusetts, who allegedly sustained injuries in line of duty on April 27, 1934, at Pittsfield, Massachusetts, while employed by the Civil Works Administration, and his claim for compensation is authorized to be considered and acted upon under the remaining pro- visions of such Act, as amended, if he files such claim with the Umted States Employees' Compensation Commission not later than six months after the date of enactment of this Act: Provided, That no benefits hereunder shall accrue prior to the approval of this Act.
