AND WHEREAS on the morning of March 13th, 1979 the people of Grenada in the exercise of their sovereignty overthrew the regime of Eric Gairy. This sovereign act of necessity involved the suspension of The Grenada Constitution Order 1973.

AND WHEREAS on the 25th day of March, 1979, the following ten People's Laws enacted by the People's Revolutionary Government were orally declared by the Prime Minister and popularly acclaimed.

For the removal of doubt it is hereby ORDERED and DECLARED as follows :-

PEOPLE'S LAW NO. 1
SUSPENSION OF CONSTITUTION

The Constitution of Grenada is hereby and has been suspended as of 12.01 a.m. on March 13th, 1979. All Acts and/or deeds by or under the authority of the People's Revolutionary Government (PRG) are hereby deemed and declared to have been legally done and shall not be called unto question in any Court of Law or otherwise.

PEOPLE'S LAW NO. 2
ESTABLISHMENT OF PEOPLE'S REVOLUTIONARY GOVERNMENT

The People's Revolutionary Government (PRG) is hereby established as of Tuesday, 13th March 1979, and in it shall be vested all executive and legislative power, and the People's Revolutionary Government shall appoint a Prime Minister.

PEOPLE'S LAW NO. 3
HEAD OF STATE

The Head of State shall remain Her Majesty the Queen and her representative in this country shall continue to be the Governor-General who shall perform such functions as the People's Revolutionary Government may from time to time advise.

PEOPLE'S LAW NO. 4
ESTABLISHMENT OF SUPREME COURT OF GRENADA

  • (a) The West Indies Associated States Supreme Court (Grenada) Act 17 of 1971 is hereby repealed.
  • (b) There is hereby established a Supreme Court of Grenada consisting of the High Court and the Court of Appeal in which shall be vested all that jurisdiction which was formerly exercised by the West Indies Associated States Supreme Court.


PEOPLE'S LAW NO. 5
CONTINUITY OF LAWS

Save as is hereinafter provided or herein or hereafter amended or repealed all existing laws shall continue in force.

PEOPLE'S LAW NO. 9
PRESERVATION OF PENSION RIGHTS

All public servants' rights and pensions as hereintofore provided under the Grenada Termination of Association Order 1973 shall be preserved.

PEOPLE'S LAW NO. 10
DECLARATION AND EFFECT OF LAWS

For the time being all People's Laws shall become effective upon oral declaration and/or publication on Radio Free Grenada by the Prime Minister or in the official Gazette under the hand of the Prime Minister.
