Re: Amendments to the Act Regulating Prosecutorial Public Servants, 2521 BE


Whereas it is appropriate to amend the Act Regulating Prosecutorial Public Servants, 2521 BE as a result of the fact that the justice administration system should be modified in respect of the public prosecution service so as to bring about efficiency to the performance of duties and rectify certain practical problems and obstacles, the Chief of the Council for Democratic Reform hereby announces as follows:

Article1.The provisions of section 18 of the Act Regulating Prosecutorial Public Servants, 2521 BE shall be repealed and replaced by the following provisions:

Section18.In the event that a position of PPSC[1] Member under section 15 becomes vacant and there arises an urgent need to carry out any action, the remaining PPSC Members shall be able to proceed therewith if they are in a sufficient number to establish a quorum.”

Article2.The provisions of section 27 of the Act Regulating Prosecutorial Public Servants, 2521 BE shall be repealed and replaced by the following provisions:

Section27.In order to appoint a prosecutorial public servant to a position other than assistant prosecutor, the PPSC President shall make a proposal to the PPSC for its prior approval, taking into account the knowledge, ability, responsibility, and service history of the person in question, compared with the works in the position he is to be appointed to. But this does not exclude the right of any PPSC Member to make such proposal. Once the approval is given, notification shall be made to [the Monarch] for effecting the appointment.”

This Announcement shall take effect from now on.
