Only in an honorable fashion is he to receive them. But if he's a homeowner and gives the privilege to a Talmid Chakham who is a guest at his rabbi's house, consisting of the gifts that his rabbi usually gives him, it's forbidden (Rashi and Tur). 15 editIf the gifts were not given to the Kohen but instead he ate them or lost them - he's exempt from human law, but in order to fulfill the laws of Heaven, he must set aside their money worth. 16 editIf an Yisrael sent meat to his friend with the gift parts, it's permitted to eat them. 17 editGifts are only applicable to ox and sheep, but not to wild animals and birds. They are also applicable to Kilayim-mixed species, from a goat and ewe, and also from koy (prob. a bearded deer or antelope, Chull. 80a). 18 editOne who owns a female deer that gave birth is obligated to give half of the gifts, but if one owns a male deer that had offspring he is exempt from the gifts. 19 editThe gifts don't apply to consecrated beasts or firstborn males. 20 editIf a firstborn before being brought to a Kohen was mingled with other beasts, he's obligated to give the gifts from them, for the Kohen can say on each one, "Give me this one's gifts, and if you say it's a firstborn give me all of it." But when a firstborn had one that's equal to it given to the Kohen but it got sold to an Yisrael and mixed among other beasts - if there are many that shekht them they are all exempt, as each one can say "Mine is the firstborn" - but if one person shekhts all of them they only exempt him for one of them. 21 editGifts are applicable anywhere, whether in the Land or outside of it, whether in the presence of the Temple or not. There are those that say the gifts are not applicable outside the Land, and that's their practice. 22 editKohanim are exempt from giving the gifts. 23 editLevites it's doubtful whether they have to give the gifts, therefore they're exempt. And if he is a partner with them in the stomach, he is exempt only from the liver. 27 editIf there is an animal that belongs to the Kohein, and its head is sold to a Yisrael, and the rest of the body is left with the Kohein, the Yisrael is obligated to give the cheek. 28 editThe one who slaughters an animal belonging to an Yisrael is obligated to give the gifts from it to the Kohein. But if he slaughters an animal belonging to a Kohein or a non-Jew, he is exempt. 29 editIt is beneficial for the owner to give the gifts to any Kohein he wishes (Beit Yosef, quoting from Rabeinu Yitzchak). It is forbidden for the owner to take a dinar from the Kohein to give him his gift. Similarly, it is forbidden for an Yisrael to give gifts to a Kohein for his son or daughter (Beit Yosef, quoting from Ri and in Perek Ad Kamah). 30 editA Kohein who sold a cow to an Yisrael and said to him: "I am selling you this cow, excluding its gifts," it is a condition, and he must give the gifts to the buyer. But if he said to him: "On the condition that its gifts are mine," and the sale remains, he can give them to any Kohein he wishes. 31 editAn Yisrael who sold a cow to a butcher and left the gifts, the buyer is obligated to give them, even though they remained with the seller temporarily, the obligation is on the buyer, who is the butcher. 32 editThe gifts themselves are forbidden for an Yisrael to consume, except with the permission of a Kohein who transgressed and consumed them, or an elderly person, or if the Kohein sold them.
