AN ORDINANCE IMPOSING PAYMENT OF FEES AS MONTHLY RENTAL FOR THE FOURTEEN (14) UNITS STALLS FOR DRY GOODS CONSTRUCTED AT THE RIGHT SIDE OF THE URBIZTONDO PUBLIC MARKET.

Be It Ordained By the Sanggunian Bayan of Urbiztondo, Pangasinan in session assembled that:

SECTION 1. Title. – This Ordinance shall be known as, “An Ordinance Imposing Payment of Fees as Monthly Rental for the Fourteen (14) Units Stalls for Dry Goods Constructed at the Right Side of the Urbiztondo Public Market, Providing Guidelines for Occupancy and Operation Thereof.”

SEC. 2. Purpose. – The payment of fees shall serve as monthly rental of the fourteen (14) units market stalls which the stallholder shall pay to the Municipal Treasurer or to his/her duly authorized representative.

SEC. 3. Terms and Corresponding Fees. – The terms and corresponding fees as monthly rentals of each of the fourteen stalls shall be Php1,500.00, subject to amendment after three (3) years to adopt to existing economic conditions.

SEC. 4. General Provisions.
(a) Stallholders shall pay the monthly rental regularly on or before the 5th day of the month to the Municipal Treasurer or his/her duly authorized representative. Unpaid monthly rental for (3) months in spite of (2) notices to concerned stallholder will cause the closure of the stall and cancellation of the lease Contract.

(b) All stallholders are required to secure the necessary permit and license before the actual business/operation pursuant to the Revised Municipal Revenue Code of the Municipality of Urbiztondo.

(c) Section 5 General Provisions and Section 6 Penalties of the Ordinance Imposing Fees for Stall Rights (Goodwill) for the Fourteen (14) Units Stalls for Dry Goods Constructed at the Right Side of the Urbiztondo Public Market, shall apply in this ordinance.

SEC. 5. Separability Clause. – Should any provision of this ordinance be subsequently declared by a competent authority to be unconstitutional or invalid, the other provisions not so declared shall not be affected by such declaration and shall remain in full force and effect.

SEC. 6. Repealing Clause. – Any ordinance or any provision thereof found to be inconsistent with this Ordinance are hereby deemed modified, amended and or repealed accordingly.

SEC. 7. Effectivity. – This Ordinance shall take effect upon favorable review by the Sangguniang Panlalawigan of Pangasinan and after its publication pursuant to the provisions of Republic Act No. 7160.
