Provided always, That no Aflenment, Rate or Tax, fliall be made, co]le(^Gd or levied, upon, High lands not for or in refped of any High Lands, within the Boundaries aforefaid, not fubject to Inundations -, and if to ije charged. any biTpute (hall ariie, whether any of fuch Lands ought to be deemed High Lands, the fame (hall be determined by five or more of the faid Commiflioners, at any of their faid Meetings ; but in cafe they fiiall ^"„^Q-^g° jn'/,7 not determine fuch Difpute within three Months after they fhali be requefted fo to do, or if any Perfon or Perfons ihall think, himfelf, herfelf or themfelves, aggrieved by fuch Determination of the faid Com- hn'flioners, then it Ihail and may be lawful for him, her or them, to apply and appeal to the Juftices of the Peace, or the major Part of them, at their General Quarter-Seflion of the Peace, or Adjournment thereof, to be holden for the aforefaid Divifion of the faid County of Norfolk, within fix Months nfter fuch Difpute or Determination (hall happen j which faid Juftices fliall and may adjourn fuch Difpute and Appeal to any other Seflion of the Peace for the faid Divifion of the faid County, and finally determine the fame at any of the faid SefTions, and give fuch Cofts to either Party as they fhall think, rea- fonabie. And be it further enacted by the Authority aforefaid.
